<br />DES:djk 04/09/97 <br /> <br />(014/72) <br /> <br />1998 <br /> <br />June <br /> <br />30, <br /> <br />1999 <br /> <br />the <br /> <br />sum shall <br /> <br />be Two Thousand <br /> <br />Seven <br /> <br />Hundred <br /> <br />Twenty <br /> <br />and <br /> <br />No/100 <br /> <br />Dollars <br /> <br />($2,720.00) <br /> <br />payable in semi-annual equal installments each. <br /> <br />4. <br /> <br />Ci ty makes <br /> <br />no warranties <br /> <br />or <br /> <br />representations <br /> <br />regarding <br /> <br />the <br /> <br />Range's <br /> <br />suitability <br /> <br />or <br /> <br />adequacy <br /> <br />for <br /> <br />Permittee's weapons use or training. <br /> <br />5. <br /> <br />The term of this Permit is two <br /> <br />(2 ) <br /> <br />years, <br /> <br />to <br /> <br />wit: <br /> <br />July 1, <br /> <br />1997 <br /> <br />June <br /> <br />30, <br /> <br />1999, <br /> <br />unless <br /> <br />sooner <br /> <br />terminated <br /> <br />by <br /> <br />either <br /> <br />party <br /> <br />pursuant <br /> <br />to <br /> <br />paragraph <br /> <br />8. <br /> <br />Notwithstanding <br /> <br />the <br /> <br />foregoing, <br /> <br />this <br /> <br />Permit <br /> <br />may <br /> <br />be <br /> <br />renewed annually, upon the expiration of said term by <br /> <br />motion duly made and carried by City's City Council. <br /> <br />6. <br /> <br />Permittee shall only allow active and reserve <br /> <br />peace <br /> <br />officers <br /> <br />of <br /> <br />Permittee's <br /> <br />Police <br /> <br />Department, <br /> <br />so <br /> <br />qualified under the California Penal Code, <br /> <br />to use or <br /> <br />enter the Range pursuant hereto. <br /> <br />7 . <br /> <br />The Range shall be open and available for use <br /> <br />by Permittee at such times as are mutually agreed upon <br /> <br />by <br /> <br />both <br /> <br />parties <br /> <br />hereto; <br /> <br />provided, <br /> <br />that <br /> <br />City <br /> <br />will <br /> <br />endeavor to make the Range available <br /> <br />for use only by <br /> <br />Permittee three <br /> <br />(3 ) <br /> <br />days per quarter and an additional <br /> <br />five (5) days per year for a total of 17 days per year. <br /> <br />However, <br /> <br />it is expressly understood that sole use of <br /> <br />the Range by Permittee shall be subject to the prior <br /> <br />approval of City, and at City's sole discretion. <br /> <br />8. <br /> <br />This Permit may be terminated by either party <br /> <br />by giving at least thirty (30) days' written notice to <br /> <br />the other party before the termination date. <br /> <br />2 <br />
