<br />10. <br /> <br />Indemnification. <br /> <br />It is agreed that District shall defend, save harmless and <br /> <br />indemnify City, its officers and employees, from any and all claims for injuries or damage to <br /> <br />persons and/or property which arise out of the terms and conditions of this Agreement and <br /> <br />which result from negligent acts or omissions of District, its officers and/or employees, It is <br /> <br />further agreed that City shall defend, save harmless and indemnify District, its officers and <br /> <br />employees from any and all claims for injuries or damages to persons and/or property which <br /> <br />arise out of ths terms and ccndiUons of this Agreement and which result from negligent acts or <br /> <br />omissions of City, its officers and/or employees. <br /> <br />In the event of concurrent negligence of the District, its officers and/or employees, and <br /> <br />City, its officers and/or employees, then the liability for any and all claims for injuries or <br /> <br />damages to persons and/or property which arise out of the terms and conditions of this <br /> <br />Agreement shall be apportioned under the California theory of comparative negligence as <br /> <br />established presently, or as may hereafter be modified. <br /> <br />11. <br /> <br />Insurance Requirements. District and City shall obtain and maintain during the <br /> <br />term of this Agreement, and furnish each other with certificates of insurance of comprehensive <br /> <br />liability insurance. Coverage shall include, but not be limited to, losses, damages, claims or <br /> <br />demands arising out of bodily injury, including death resulting therefrom, and/or damage to <br /> <br />property, including loss or use thereof, which results or is alleged to have resulted from the <br /> <br />performance or omission of any service or act called for in this agreement by the respective <br /> <br />insured parties. Amounts of coverage shall be a minimum of one million for each individual, <br /> <br />one million for each occurrence, and one million for property damage. <br /> <br />12. <br /> <br />Termination.
