of the territory to which said rights have been allocated prior to such change in organization or reorganization. County shall administer such capacity rights pursuant to this agreement for the benefit of said territory and the successor district or governmental authority having jurisdiction and providing sanitary sewerage service to said territory. 8. RELATED DISTRICT AGREEMENTS DEEMED AMENDED. To the extent, if at all, agreements entered into by County for or on behalf of the Related Districts, or any such district, include provisions for the furnishing of sanitary sewerage treatment or the providing of sanitary sewerage treatment capacity, whether expressly or by implication, such agreements shall be deemed amended hereby such that the amount of capacity rights allocated to such Related Districts shall be determined pursuant to and in accordance with this agreement. 9. LIMITATION OF AGREEMENT. It is understood and agreed that this agreement pertains solely to the allocation and furnishing of grant eligible and non-grant eligible çapacity rights for the benefit of the Emerald Lake Hills Area, and not to the furnishing of any related sewerage services or facilities. No provision or guarantee is made hereunder for the collection, transmission, pumping, or other transporting of sewage emanating froM said Area. Provision for such collection, transmission, pumping, and trans- porting of sewage received or to be received into City's sanitary sewerage system, or those of any other public entity, and ultimately transported by Authority's transmission facilities, are, or shall be, if at all, made pursuant to separate agreement. 10. EXCUSE OF PERFORMANCE. In the event Authority's treatment plant is not constructed, or after construction, does not operate or is prevented from operating so as to treat sewage -15-
