DES:sh 2/17/87 (#30) day) sanitary sewerage treatment capacity rights for the benefit of lands located wi thin the area thereafter established as the Emerald Lake Heights Sewer Maintenance District; and WHEREAS, pursuant to Resolution No. 9690, adopted October 9, 1984 by the Council of the City of Redwood City, the lands hereinafter described (the "Excluded Territory") were annexed to the City of Redwood City; and WHEREAS, pursuant to Section 4926 of the Sewer Maintenance District Act (Health and Safety Code §§4860 et seq.) the Council of the City of Redwood City has adopted a resolution requesting exclusion of the Excluded Territory from the Emerald Lake Heights Sewer Maintenance District; and WHEREAS, the County and the Ci ty desire to confirm that treatment capacity rights allocated to the County pursuant to the Capacity Agreement in the amount of one (1) dwelling unit equivalent (250 gallons per day of wastewater volume) shall be reallocated to the City for treatment of sewage emanating from the Excluded Territory and that the allocation of treatment capacity rights under the Capacity Agreement shall be reduced correspondingly; and WHEREAS, paragraph XI of the Transmission Agreement provides that said agreement may be revised, altered, amended or supplemented by written agreement; and WHEREAS, the parties hereto desire to supplement the Transmission Agreement by providing for the exclusion of the Excluded Territory in the service area specified in said Agreement; 2
