DES:sh 2/17/87 (#30) NOW, THEREFORE, in consideration of the above premises, the parties hereto agree as follows: 1. Exhibit "A" of the Transmission Agreement shall be, and is hereby, amended to exclude the Excluded Territory comprised of all that certain real property situate in the County of San Mateo, State of California, depicted on Exhibit "A" hereof, attached hereto and by this reference incorporated herein, and more particularly described as follows: All that certain real property located in the City of Redwood City, County of San Mateo, State of California, more particularly described as follows: Parcels A and B of Parcel Map 85-3 filed in the office of the Recorder of the County of San Mateo, State of California on February 26, 1986 and recorded in Book 56 of Parcel Maps at Page 94, being a subdivision of Lots 12 and 13, respectively in Block 203, as said lots and block are shown on that certain map entitled "Highlands of Emerald Lake Subdivision Two", San Mateo County, California, filed in the office of the Recorder of the County of San Mateo, State of California on October 18, 1926 and recorded in Book 14 of Maps at Pages 37 and 38. (APN 057-234-230 & APN 057-234-240) 2. The parties hereto confirm and agree that treatment capacity for sewage emanating from the Excluded Territory shall be furnished in the amount of one ( 1 ) dwelling unit equivalent (250 gallons per day wastewater volume) by reallocation to the Ci ty of Redwood City, of that amount from the capacity rights allocated under the Capacity Agreement; said treatment capacity rights are hereby so reallocated, and the amount of capacity rights allocated under the Capacity Agreement are hereby correspondingly reduced. 3
