<br />PUBLIC HEARINGS (continued) <br /> <br />Item No.2 (continued) <br /> <br />Vice Mayor Britschgi declared the public hearing open at 7:56 p.m. <br /> <br />Affidavit of Mailing reported on file. <br /> <br />Thomas Gutierrez, 1680 Kansas Street, sta ted that he had received writ ten <br />notice but that some prospective neighbors of the subject house did not <br />receive notice. City Attorney Schricker advised that written notice is <br />required to be sent only to owners of property within 300' of the affected <br />property and that renters or other tenants would not receive notice. <br /> <br />In response to question, Mr. Malkemus described the process for house move <br />permits, noting that any house would be required to be brought up to Code. <br /> <br />In response to question, City Clerk Hildebrand reported that on July 13, 1982, <br />19 notices were sent to property owners on the list provided by the Building <br />Department. <br /> <br />Mabel Bell, 1660 Kansas Street, stated that she understood the subject <br />property was zoned for a duplex. It was explained that no variance is <br />required if a developer wishes to put fewer units than allowed on residential <br />property. <br /> <br />Jim Bell, 1660 Kansas Street, said he agrees with previous speakers. <br /> <br />City Attorney Schricker replied to questions regarding the finding required to <br />be nade by Council, stating that if no action is taken within 30 days of the <br />date of the application, that the permit is issued, action being required <br />within 30 days. <br /> <br />Mr. Malkemus noted that subject application was made on June 17, 1982 so that <br />more than 30 days have passed, but that the applicant had agreed to the delay <br />in Council consideration. <br /> <br />CONSENSUS: Vice Mayor Britschgi determined it was the consensus of Council <br />that Mr. Malkemus meet with Mr. Gutierrez and others in the audience and <br />return later in the evening for consideration of the house move permit. <br />(See page 3 below) <br /> <br />------------------------------------------------ ----------------------------------------------- <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> <br />REPORTS OF BOARDS AND COMMISSIONS <br /> <br />None <br /> <br />None <br /> <br />------------------------------------------------ ----------------------------------------------- <br /> <br />REPORTS OF CITY MANAGER <br /> <br />REPORTS OF CITY MANAGER <br /> <br />3. Auchincloss (undated) <br /> <br />Councillllan Biagi reported that he and City Attorney Schricker had met with <br />Stuart Auchincloss, attorney representing the Peninsula New Life Center and <br />referred to Mr. Auchincloss' memorandum. <br /> <br />Stuart Auchincloss, lawyer, 2000 Broadway, referred to his memorandum, stating <br />the Center is requesting that Council adopt a procedural ordinance to provide <br />for the City to issue health facility revenue finance bonds and to adopt a <br />preliminary "comfort" resolution stating the Council is favorable to the <br />specific prOject and would like to proceed with it. Mr. Auchinc loss sta ted <br />that adoption of the requested ordinance and resolution would not finally <br />commit the Council to issue the bonds, since an ordinance doing so would be <br />required later. <br /> <br />Reg.
