Public Hearing - Appeal of determination of violation of <br />Zoning Ordinance and Use Permit~ Open Gate Nursery - <br />Unitarian Fellowship Church~ 2124 Brewster Avenue, <br />appellant <br /> <br />Report of City Manager and Planning Director transmitting record 11/9/82. <br /> <br />Planning Director Schroeter described the background leading to his letter <br />of October 19, 1982 to the Unitarian Fellowship serving notice of <br />violations of the Zoning Ordinance and Use Permit granted December 12, <br />1977. Mr. Schroeter stated that the application for Use Permit stated <br />that the property was to be used by a child care nursery operating three <br />days a week (Monday, Wednesday and Friday) for two and one-half hours each <br />day during the school year only and that the Council made three conditions <br />relating to physical facilities. <br /> <br />Mr. Schroeter stated that it has been his understanding that the Use <br />Permit was limited by statements on the application repeated in testimony <br />at the 1977 public hearing. He reported that the applicant believes the <br />only limitations on the Use Permit are the three conditions relating to <br />physical facilities without reference to the other statements.
