<br />the space utilized by the permittee is necessary to the <br /> <br />conducting of an activity in recognition or celebration <br /> <br />of a <br /> <br />national, state or locally declared, holiday or <br /> <br />of a day or <br /> <br />days for which a national, state or local proclamation has <br /> <br />been issued. <br /> <br />A permit suspended pursuant to this section shall be <br /> <br />reinstated as soon as reasonably possible after the completion <br /> <br />of the supervening activity. <br /> <br />Upon reinstatement, the period for which the permit was <br /> <br />granted shall be extended by a period equalling the duration <br /> <br />of the suspension. <br /> <br />"Section 33A.25. <br /> <br />Permit Duration. <br /> <br />(a) <br /> <br />No encroachment <br /> <br />permit shall be issued for a period exceeding 15 days, excepting <br /> <br />permits for the conducting of a sidewalk cafe which may be <br /> <br />issued for a period of up to 120 days. <br /> <br />"(b) <br /> <br />Not more than three encroachment permits shall be <br /> <br />issued to the same applicant, or partner, agent, licensee or <br /> <br />representative thereof, in any calendar year, excepting permits <br /> <br />for activities to be actually conducted by an association of <br /> <br />merchants meeting criteria set forth in Section 33A.3I(f) (I). <br /> <br />Temporary Permit. <br /> <br />All permits granted <br /> <br />"Section 33A.26. <br /> <br />under this article are temporary in nature, and do not constitute <br /> <br />a deed, a grant of easement, or a leasehold interest in the <br /> <br />subject premises. <br /> <br />"Section 33A.27. <br /> <br />Permit Fee. <br /> <br />All applications for an <br /> <br />encroachment permit shall be accompanied by a processing fee in <br /> <br />the sum of Ten Dollars ($IO.OO), no part of which shall be <br /> <br />refundable; provided, however, that no such fee shall be charged <br /> <br />for an encroachment permit involving an activity sponsored or <br /> <br />conducted by a charitable organization. <br /> <br />-5- <br />
