<br />"Section 33A.28. <br /> <br />Permit Displayed. <br /> <br />Every person to <br /> <br />whom a permit is issued hereunder shall maintain such permit <br /> <br />in a conspicuous place upon the equipment or display utilized <br /> <br />in conjunction with the permitted activity during all hours of <br /> <br />operation. <br /> <br />"Section 33A.29. <br /> <br />Hold Harmless. <br /> <br />Applicants shall agree <br /> <br />to assume the defense of and indemnify and save harmless the <br /> <br />city, its councilmen, boards, commissions, officers, employees <br /> <br />and agents, from all suits, actions, damages or claims to <br /> <br />which the city may be subjected of any kind or nature whatso- <br /> <br />ever resulting from, caused by, arising out of or as a consequence <br /> <br />of the permitted activity. <br /> <br />Compliance With Laws. <br /> <br />Prior to issuance <br /> <br />"Section 33A.30. <br /> <br />of a permit under this chapter, all applicable rules, regula- <br /> <br />tions and laws shall be complied with and all required permits or <br /> <br />licenses shall be secured in connection with the proposed <br /> <br />activity. <br /> <br />Standards for Issuance. <br /> <br />An encroachment <br /> <br />"Section 33A.31. <br /> <br />permit shall be issued by the city manager, when, from a <br /> <br />consideration of the application and from such other information <br /> <br />as may otherwise be obtained, he finds that all of the following <br /> <br />circumstances exist: <br /> <br />"(a) <br /> <br />The applicant has not knowingly and with intent <br />to deceive, made any false, misleading or <br />fraudulent statements of material facts in the <br />application for a permit or in any other document <br />required pursuant to this article; <br /> <br />" (b) <br /> <br />The applicant has met the standards in this <br />article, and paid in advance any fee required <br />and agrees to such conditions as are imposed in <br />the permit; <br /> <br />"(c) <br /> <br />The time, duration, location and size of the <br />proposed activity will not substantially disrupt <br />the orderly safe movement of pedestrian or <br />vehicular traffic, or endanger any mall improve- <br />ments or fixtures; <br /> <br />-6- <br />
