<br />SECTION 10. <br /> <br />Appeals. <br /> <br />Any user aggrieved by a determination, <br /> <br />order, or directive of the Director made pursuant to the provisions <br /> <br />of Sections 6(a), 6(b), 8, or 9 hereof may appeal such determination <br /> <br />order, or directive to the Council. <br /> <br />Written notification of such <br /> <br />appeal shall be filed with the City Clerk within ten days after <br /> <br />notification of the determination, order, or directive of the <br /> <br />Director, and shall set forth in detail the facts and reasons <br /> <br />supporting the appeal. <br /> <br />Hearing on the appeal shall be held by the <br /> <br />Council within 30 days from the date of filing the notice of appeal. <br /> <br />The appellant, the Director, and such other persons as the Council <br /> <br />may deem appropriate, shall be heard at the hearing on appeal. <br /> <br />Upon conclusion of hearing the appeal, the Council may affirm, <br /> <br />reverse or modify the determination, order or directive of the <br /> <br />Director as the Council deems just and equitable, and in furtherance <br /> <br />of the provisions, purposes, and intent of this ordinance. <br /> <br />During <br /> <br />the pendency of any such appeal, the determination, order or directive <br /> <br />of the Director shall remain in full force and effect. <br /> <br />The Council's <br /> <br />action on the appeal shall be final. <br /> <br />SECTION 11. <br /> <br />Penalty. <br /> <br />Any person violating, or causing the <br /> <br />violation of, any of the provisions of this ordinance or of the <br /> <br />provisions of any adjustment or exception <br /> <br />granted pursuant to the <br /> <br />provisions of Section 6(b) hereof, shall be guilty of a misdemeanor <br /> <br />and, upon conviction thereof, shall be punishable by a fine of not <br /> <br />more than Five Hundred Dollars ($500.00) or imprisonment for a <br /> <br />term not exceeding six months, or by both such fine and imprison- <br /> <br />ment. <br /> <br />Every day, or any portion thereof, any violation of any <br /> <br />provision of this ordinance, or of any provision of any adjustment <br /> <br />or exception granted pursuant to the provisions of Section 6(b) <br /> <br />hereof, shall continue, shall constitute a separate offense and <br /> <br />shall be punishable as hereinbefore provided. <br /> <br />SECTION 12. <br /> <br />Remedies Cumulative. <br /> <br />The remedies and penalties <br /> <br />provided for in this ordinance shall be cumulative and not exclusive, <br /> <br />and shall be in addition to any or all other remedies available to <br /> <br />the City. <br /> <br />-10- <br />
