<br />(f) <br /> <br />(g) <br /> <br />(h) <br /> <br />(i) <br /> <br />On April 4, 1977, following notice duly given, a <br />public hearing was held by this Council at which <br />consumers of the water supply of the water system <br />of the City of Redwood City had an opportunity to <br />be heard on the question of the existence of a water <br />shortage emergency condition, and all such consumers <br />were so afforded such opportunity to be heard. <br /> <br />The rules, regulations, and restrictions set forth <br />in this ordinance on the delivery of water and the <br />consumption within the water service area of the <br />City of Redwood City of water supplied for public <br />use are intended to conserve the water supply of <br />said City for the greatest public benefit with <br />particular regard to domestic use, sanitation, and <br />fire protection. <br /> <br />The specific water uses prohibited or restricted by <br />this ordinance are non-essential, if allowed would <br />constitute wastage of the water supply of the Redwood <br />City water system, and should be prohibited or restricted <br />pursuant to the provisions of Water Code Sections 350, <br />et seq., the authority granted this Council pursuant to <br />the Charter of the City of Redwood City, and the common <br />law. <br /> <br />The actions taken by and under this ordinance are exempt <br />from the provisions of Sections 21000, et seq., of the <br />Public Resources Code pursuant to Title 14, California <br />Administrative Code, Section 15071 as specific actions <br />necessary to prevent or mitigate an emergency. <br /> <br />Declaration of Emergency. <br /> <br />This Council hereby <br /> <br />SECTION 2. <br /> <br />declares, based upon the findings and determinations of Section 1 <br /> <br />hereof, that a water shortage emergency condition prevails within <br /> <br />the water service area of the City of Redwood City. <br /> <br />Definitions. <br /> <br />For purposes of this ordinance, the <br /> <br />SECTION 3. <br /> <br />following words or phrases shall have the meanings respectively <br /> <br />ascribed thereto: <br /> <br />(a) <br /> <br />Base Year - Calendar year 1976. <br /> <br />(b) <br /> <br />Billing Period - That bi-monthly or monthly period for <br /> <br />which the City measures and determines the quantity of water furnished <br /> <br />to premises and calculates a water quantity charge therefor. <br /> <br />As used <br /> <br />in this ordinance, any billing period of the base year shall include <br /> <br />any portion of such billing period which may have occurred in the <br /> <br />year preceding or following the base year. <br /> <br />-2- <br />
