<br />set forth in Section 5(a) hereof and, <br /> <br />(2) an exception to the <br /> <br />prohibitions set forth in Section 5(b) hereof, upon a finding <br /> <br />by him that such adjustment or exception is necessary to prevent <br /> <br />an emergency condition affecting the health, sanitation, or fire <br /> <br />protection of, or creating an economic hardship upon, such person <br /> <br />or user, and that the person or user to whom such adjustment or <br /> <br />exception pertains has adopted or used all practicable water <br /> <br />conservation measures. <br /> <br />Adjustments or exceptions permitted under this Section 6(b) <br /> <br />shall be made only upon written application therefor to the <br /> <br />Director setting forth a statement of justification for such <br /> <br />adjustment or exception. <br /> <br />The Director may attach conditions, <br /> <br />specifications, or other qualifying provisions to any adjustment <br /> <br />or exception granted pursuant hereto in furtherance of the general <br /> <br />purposes of this ordinance, or any provision thereof. <br /> <br />Use of water by any person or user in accordance with the <br /> <br />provisions of any adjustment or exception duly granted by the <br /> <br />Director shall not be deemed a non-essential use. <br /> <br />SECTION 7. <br /> <br />Excess Water Use Charge. <br /> <br />There is hereby estab- <br /> <br />lished an excess water use charge in the amount of Two Dollars <br /> <br />($2.00) per unit of water, or any fraction of a unit, consumed <br /> <br />by any user in excess of the water use allotment established <br /> <br />for such user under Section 5(a) hereof, for any billing period; <br /> <br />provided, however, that no excess use charge shall be imposed <br /> <br />upon any residential user for any monthly billing period in which <br /> <br />such user's consumption is five units or less, or for any bi- <br /> <br />monthly billing period in which such user's consumption is ten <br /> <br />units or less. <br /> <br />Such excess use charge shall be imposed and <br /> <br />payable at the time of billing for the billing period during <br /> <br />which such excess use occurred. <br /> <br />-7- <br />
