such right-of-way, in which case, the applicant for the sewer lateral shall obtain a permit from the Director for the installa- tion of such lateral by a licensed contractor of the applicant's choice under terms and conditions designated by the Director, and upon payment of a deposit required by the Director to cover inspection and/or staking costs. "Section 27.85. Variances. The City Manager is hereby authorized to grant revocable variances from the strict application of Section 27.81 when all of the following conditions exist: " (a) When, in the opinion of the Health Officer of the City, a private sewerage disposal system would be adequate and safe for the disposal of the waste discharge from such building or structure and would not constitute a menace to the public health. "(b) When the City Manager finds, that because of special circumstances applicable to such building or structure, including its size, shape, location, surroundings and topography of the property upon which it is located, the strict application of Section 27.81 would constitute an undue hardship upon the owner of such property. Appeals. Any person denied a variance "Section 27.86. pursuant to Section 27.85 by virtue of the failure of the City Manager to find the facts required by subsection (b) of Section 27.85 may, within ten days after notice of such deter- mination of the City Manager, appeal the denial thereof to the City Council by filing with the City Clerk a written request for a review of the decision of the City Manager and stating facts supporting such a request. Hearing on the appeal shall be held by the City Council within 30 days from the date of filing the notice of appeal. The appellant, the Manager, -32-
