Fee; Deposit or Performance Bond. "Section 27.122. The application required by the preceding section shall be in writing and shall be accompanied by a checking and inspection fee in an amount established by resolutipn adopted pursuant to the provisions of Article IX of this chapter to cover the costs of checking any plans for, and inspection of, the proposed construction within any creek, ditch, natural storm water drainage channel, storm drainage easement or public utility easement adjacent, abutting or adjoining any creek, ditch or natural storm water drainage channel of the City. Where deemed necessary by the Director, a cash deposit or performance bond may be required to guarantee completion of any proposed con- struction or alteration in accordance with the permit granted. Right of Entry. The City, its agents, "Section 27.123. officers and employees, shall have the right to enter upon any creek, ditch, natural storm water drainage channel, storm drainage easement or public utility easement adjacent, abutting or adjoining any creek, ditch or natural storm water drainage channel in the City at any time for cleaning and enlarging activities of any such creek, ditch, natural storm water drainage channel, storm drainage easement or public utility easement adjacent, abutting or adjoining any creek, ditch or natural storm water drainage channel. "Section 27.124. Nuisance. Any construction within, or alteration of any creek, ditch, natural storm water drainage channel, storm drainage easement or public utility easement adjacent, abutting or adjoining any creek, ditch or natural storm water drainage channel, in violation of any provision of this article, shall be and is hereby declared to be a public nuisance and subject to abatement or removal or enjoin- ment in the manner provided by law. -41-
