"Section 27.120. Prohibition; Permit. No retaining wall, fence, structure or physical obstruction of any kind or any construction shall be placed on, across, under or into the bed of any creek, ditch or natural storm water drainage channel, within any storm drainage easements or public utility easements or public utility easement adjacen4 abutting and adjoining any creek, ditch or natural storm water drainage channel, or against or along the bank of any creek, ditch or natural storm water drainage channel within the City, unless a permit is first obtained therefor from the Director by the person making any such alteration or change in any creek, ditch, natural storm water drainage channel, storm drainage easement or public utility easement adjacent, abutting and adjoining any creek, ditch or natural storm water drainage channel in the city. "Section 27.121. Application. All applications for a permit, as required by the preceding section, shall be made to the Director accompanied by such evidence, including plan of the proposed construction or alteration, sufficient to enable the Director to determine whether or not the proposed construction within or alteration of any creek, ditch or natural storm water drainage channel, storm drainage easement or public utility easement adjacent, abutting or adjoining any creek, ditch or natural storm water drainage channel within the City is of a substantial or permanent nature, and whether or not it constitutes any obstruction or potential obstruction to the flow of storm waters within such creek, ditch, natural storm water drainage channel, storm drainage easement or public utility easement adjacent, abutting or adjoining any creek, ditch or natural storm water drainage channel. -40-
