r'esi::)oh-se to a recent state appellate court decision involving stormwater fees. <br /> <br />In addition to the adoption of the two resolutions, the County has requested that the co- <br />permittees indemnify the District to the extent of the charges collected on its behalf to fund <br />the NPDES program. In other words, if the NPDES program is challenged, the City would <br />be responsible for payment of its portion of the NPDES charges. <br /> <br />Alternatives <br />The City could opt out of the countywide stormwater program and fund an individual <br />municipal stormwater program; however, this would require the City to obtain its own <br />municipal NPDES permit from the RWQCB. The City Council could also choose to fund <br />the program through some other source of City funds or revert to funding the program <br />through the Sewer Enterprise Fund. <br /> <br />Fiscal Impact <br />The total cost to support the NPDES program is covered by the parcel fees with no impact <br />on City funds. Should the District program be successfully challenged, the City could be <br />responsible for payment of its portion of the NPDES charges that were collected on its <br />behalf. <br /> Marilyn W.
