<br />7ð,(/ <br /> <br />will build improvements for outdoor dining on a portion of the site. The terms of the <br />sublease have yet to be finalized but will include provisions requiring the restaurant to <br />pay for the improvements to the dining area, as well as a portion if not all of the costs of <br />maintenance for the entire Paseo area. Staff is currently working with Tarboosh <br />owners on the sublease and will bring it back to the Agency Board at a later date for <br />consideration and approval. <br /> <br />In addition to the sublease provisions, the Outlease Agreement between the Agency <br />and the USPS contains the following basic terms: <br />1. The Agency will lease the site identified in Exhibit A of the Agreement <br />(with the exception of the building and parking lot) for a five-year term <br />beginning November 1, 2005, with automatic 12 month extensions <br />thereafter. If USPS wants to terminate the agreement, they are required <br />to give the Agency a 6 month notice. <br />The Agency will maintain the area in an acceptable manner in lieu of a <br />lease payment to USPS. <br />The Agency will fund and construct the improvements described in the <br />Agreement with the exception of the $10,000 rolling security gate for the <br />to-be-enclosed parking lot for USPS employees to the rear of the post <br />office. <br />USPS acknowledges that the outdoor dining area will be improved by <br />Tarboosh Restaurant via a sublease with the Agency. The sublease must <br />be reviewed and approved by USPS. <br />USPS has exempted the Agency and the sublessee from the restrictions <br />against the sale and/or use of alcohol on Post Office property. <br />The Agency will furnish utilities for all of the areas it is responsible for <br />maintaining. <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />6. <br /> <br />Desian Features <br />The Paseo's main walkway, east of the Post Office and beginning at the parking lot, will <br />be comprised of a 'landing' contoured with an 18-inch high seat wall. an eight-foot wide <br />concrete path lined with pedestrian scale streetlights, and two information podiums <br />explaining the demonstration dry creek bioswale. The walkway then leads up to a <br />decoratively paved area which will be divided into three uses: a walkway that <br />continues to the sidewalk and the contiguous crosswalk, the dining area adjacent to the <br />restaurant, and the plaza lined with flowering deciduous trees, benches, and a <br />newspaper rack. <br /> <br />Behind the Post Office, a new, six-foot, wrought-iron fence will surround the employee <br />parking lot. The entrance to the lot will be announced by a decorative, rolling security <br />gate. Adjacent to the lot there will also be a pedestrian scale gate which leads to a <br />pathway that meets the eight-foot public walkway along the west side of the building. <br />Adjacent to this walkway is a grassy swale, an information podium and six new parking <br />stalls (including one accessible stall and ramp) comprised of decorative pavers.
