The combined site area <br />is approximately 19,550 square feet. Both parcels are located within the General <br />Commercial - Combined Residential (CG-R) Zoning District. <br /> <br />The City received this application on August 25, 2005 and held a public hearing on <br />September 14, 2005. The Zoning Administrator was not able to make the findings <br />required by Article 42 Section 3 of the Zoning Ordinance, Zoning Administrator Action, <br />as follows: <br /> <br />"The Zoning Administrator...... shall grant, or conditionally grant the Use <br />Permit applied for only if he or she finds that the establishment, <br />maintenance, or operation of the use applied for would not, <br />under the circumstances of the particular case, be detrimental to <br />the health, safety, peace, morals, comfort, or general welfare of <br />persons residing or working in the neighborhood of such proposed <br />use or would not be detrimental or injurious to property or improvements <br />in the neighborhood or to the general welfare of the City." (Emphasis <br />added.) <br />
