Nicoll Enterprises strongly believes that the City Council will fmd this is a <br />fun activity that benefits the community and that the burdens on adjacent property owners <br />are no more significant than the many other commercial activities in the immediate area. <br /> <br />, <br /> <br />THE TREE LOT SHoULD BE EV ALUA TED <br />" <br />BY ITS CURRENT, MITIGATED ACTIVITY <br /> <br />In response to inquiry from the Zoning Administrator in November 2004, Nicoll <br />Enterprises proposed several measures that - in fact -limited the burdens of this activity <br />on the neighbors. The Zoning Administrator's decision virtually ignores the proven <br />success of these steps during the Christmas tree sales last December. <br /> <br />Nicoll Enterprises proposed - and then implemented - all of these measures. <br />None of these measures was required by the terms of the special use permit Redwood <br />City granted in 2004, although they were later adopted by the City after Nicoll suggested <br />them: <br /> <br />. A large sign (5' tall) with reflective lettering asked customers, <br />"Please do not block driveways. Our neighbors live here." <br /> <br />. On the weekends when customer traffic is greatest, traffic attendants in <br />safety vests directed customers to alternative parking. (As specified in <br />the use permit, off-street parking was arranged with nearby businesses.) <br /> <br />. All personnel were trained by a qualified inspector in traffic safety <br />techniques. <br /> <br />. Customers were not allowed to tie trees to their cars, except in front of <br />the tree lot, where the operator assisted them. <br /> <br />. Storage at the back of the site was fenced with a dark-green, opaque <br />fencing material to cloak the storage from the view of the neighbors. <br /> <br />. No delivery vehicles were parked on the site. <br /> <br />. In the evenings, tree trunks were trimmed only with an especially quiet, <br />electric saw. In addition, Nicoll used handsaws after 8:00 p.m.! <br /> <br />. Gas saws were never used at any time. <br /> <br />. Tree deliveries, which happen no more than three times, are made at <br />approximately 10 a.m. on weekdays only, when traffic is lightest.
