<br />$-/3 <br /> <br />Staff Report <br />To: Planning Commission <br />Subject: Stormwater Amendments <br />October 4, 2005 <br />Page 5 of 6 <br /> <br />provide allowances in most cases for minor changes on a site, and in some cases (such <br />as encroachments into creek setbacks) allows deviations through a conditional use <br />permit process. Staff believes the amendments recognize that some of these changes <br />may otherwise affect existing development adversely, if such flexibility is not proYided. <br /> <br />< <' <br />Grandfathered Facilities in Industrial Districts <br /> <br />, ' <br /> <br />The proposed amendments include three provisions that are unrelated to stormwater <br />facilities, specifically the changes to Zoning Ordinance sections 17.15, 18.18, and <br />19.11. These sections modify the grandfathering of nonconforming facilities in the IR, <br />IP, and GI industrial districts. The revisions are clean-up items to make those sections <br />more consistent with the proYisions of Artic;le 33, which was updated in 2004. <br /> <br />GENERAL PLAN COMPLIANCE: <br /> <br />The current General Plan does not specifically address stormwater issues, though it <br />does generally suggest protection of environmental resources and prevention of <br />drainage impacts (particularly in the Open Space and Conservation elements). The <br />Conservation Element of the General Plan should be amended to reflect the intent of <br />the ordinance revisions through a series of goals, objectives and implementation <br />criteria. Staff will include these provisions in the ongoing update of the General Plan. <br />Examples of such policy language was included in a May, 2002 report to the <br />Commission. <br /> <br />ENVIRONMENTAL REVIEW: <br /> <br />Staff has determined that environmental review of the ordinance amendments is <br />categorically exempt from the proYisions of the California Environmental Quality Act <br />(CEQA). Class 5 (Section 15305 of the CEQA Guidelines) exempts minor alterations in <br />land use limitations. The proposed amendments are minor in nature and would <br />comprise protective environmental measures, rather than allowing greater potential for <br />development and environmental impacts. <br /> <br />PUBLIC NOTIFICATION AND OPPORTUNITIES FOR PUBLIC INPUT: <br /> <br />Public notice of the Planning Commission meeting was published in the Redwood City <br />Independent on September 27, 2005. Notice was also sent to interested parties. <br />Subsequent public notice will be provided for the City Council's consideration of the <br />ordinance. <br /> <br />Public input will also be available during the course of Planning Commission and City <br />Council public hearings on the proposed amendments. <br />
