6.3.A. - Page 1
REPORT
To the Honorable Mayor and City Council
From the City Manager
February 26, 2018
SUBJECT
First Reading (Reintroduction) of Zoning Ordinance Amendments and Second Reading
(Adoption) of City Code Amendments, Both Regarding Short Term Rental Regulations
RECOMMENDATION
Waive the Second Reading and Adopt the City Code Amendments, and Waive the First
Reading and Reintroduce the Zoning Ordinance Amendments
BACKGROUND
On January 8, 2018, the City Council introduced and approved amending the City Code
and Zoning Ordinance.
ANALYSIS
On January 8, 2018 the City Council waived the first reading and introduced two
ordinances regarding short-term rentals. The January 8, 2018 staff report is attached to
this report and contains additional background and analysis. The subject ordinances
(Attachments 1 and 2) make changes to the Transient Occupancy Tax (TOT) Ordinance
and add a new section to the Zoning Ordinance regulating Short Term Rentals.
The City Council also requested that staff bring back language that could limit the
number of listings allowed at any one time in a residence. Staff is proposing a limitation
of two listings at any one time. This will help reduce potential parking and noise impacts
to nearby neighbors and support the residential character of the neighborhood. This
language is included in the attached ordinance. Because the Zoning Ordinance includes
new language as described above, staff is recommending that this ordinance be
reintroduced at this time. The amendments to the City Code, which remain unchanged
from the January 8 meeting, are being recommended for adoption.
If adopted, these ordinances will be effective 30 days from this action. The zoning
ordinance contains a year-long amnesty period to allow time for staff to develop a
registration process and for property owners to bring their properties into compliance.
ALTERNATIVES
The City Council may consider the following alternatives,
