Through this Agreement, Agency grants to Contractor an exclusive franchise, except 244 <br />as provided in Section 4.01.B and in Section 4.02, to Collect the following materials 245 <br />in the Service Area: 246 <br />1. Solid Waste generated at Residential Premises, Commercial Premises and 247 <br />Agency Facilities; and, 248 <br />2. Source Separated Targeted Recyclable Materials and Source Separated Organic 249 <br />Materials generated at Residential Premises. 250 <br />B. Through this Agreement, Agency grants to Contractor a non-exclusive right to Collect 251 <br />the following materials in the Service Area: 252 <br />1. Source Separated Targeted Recyclable Materials and Source Separated Organic 253 <br />Materials generated at Commercial Premises; 254 <br />2. Major Appliances and Specialty Recyclable or Reusable Materials generated at 255 <br />Residential Premises; and 256 <br />3. Non-putrescible wastes placed in Drop Boxes. 257 <br />4.02 LIMITATIONS ON SCOPE 258 <br />Agency may permit the Collection, Recycling, or Disposal of any of the following materials 259 <br />by Persons other than Contractor without seeking or securing any approval from 260 <br />Contractor: 261 <br />A. Solid Waste, Targeted Recyclable Materials, and Organic Materials which are 262 <br />transported personally by the Owner or Occupant of the Premises at which they are 263 <br />generated (or by his or her employees) to a processing or Disposal facility; 264 <br />B. Targeted Recyclable Materials and Organic Materials which are Source Separated 265 <br />by the Generator and donated to youth, civic, or charitable organizations; 266 <br />C. Recyclable beverage containers delivered for Recycling under the California 267 <br />Beverage Container Recycling Litter Reduction Act, Section 14500 et seq. California 268 <br />Public Resources Code; 269 <br />D. Animal waste and remains from slaughterhouse or butcher shops, grease waste, and 270 <br />used cooking oil; 271 <br />E. By-products of sewage treatment including sludge, sludge ash, grit, and screenings; 272 <br />F. Hazardous Waste, Household Hazardous Waste, and Infectious Waste; 273 <br />G. Source Separated E-Scrap and Source Separated Universal Waste; 274 <br />H. Organic Materials composted at Residential and Commercial Premises; 275 <br />I. Materials generated by State facilities (including public schools), provided that the 276 <br />Generator has arranged services with other Persons or has arranged services with 277 <br />the Contractor through a separate agreement; 278 <br />6.2.B. - Page 22
