Major Appliances, Universal Waste, and E-Scrap shall 933 <br />be reused, Recycled, or Disposed by Contractor in accordance with requirements of 934 <br />Applicable Law. Any changes to such regulations made after January 1, 2011 shall 935 <br />be addressed as though they are a Change in Law in accordance with Section 11.05. 936 <br />G. Collection and Processing Methods. All materials that can be handled by the SFD 937 <br />Single-Stream Recycling, Organic Materials, or Solid Waste route Collection vehicle 938 <br />would be assigned to one of these vehicles for Collection, with the goal of maximizing 939 <br />diversion. All Collection of Bulky Items will be assigned for Collection by a Collection 940 <br />vehicle, and the driver will segregate items Collected according to their suitability for: 941 <br />(1) reuse or Recycling, and (2) Disposal, prior to their transport to Shoreway 942 <br />Recycling and Disposal Center for processing. Any remaining items will be Collected 943 <br />by a dispatched Collection vehicle. Contractor shall utilize these procedures and 944 <br />vehicles in a manner that provides the maximum diversion of the material Collected 945 <br />from the On-Call Bulky Item Collection Service event. 946 <br />H. Maximum Number of Daily Events. Contractor shall schedule up to a maximum of 947 <br />one hundred fifty (150) On-Call Curbside Bulky Item Collection Service events per 948 <br />service day for the SBWMA Service Area (“daily limit”). The maximum number of 949 <br />daily events includes On-Call Bulky Item Collection Service events provided to both 950 <br />Single-Family and Multi-Family Residential Complexes, and those events provided at 951 <br />no charge and events paid for by the Customer, Owner, or property manager. 952 <br />Contractor shall schedule On-Call Curbside Bulky Item Collection Service events no 953 <br />more than ten (10) Business Days after the Owner’s or Occupant’s request up to the 954 <br />maximum number of daily events. Upon reaching the maximum number of daily 955 <br />events, requested On-Call Curbside Bulky Item Collection Service event shall be 956 <br />scheduled on the next available regularly scheduled Solid Waste Collection Day. 957 <br />SBWMA may adopt an allocation system for On-Call Bulky Item Collection Service 958 <br />events, in order to allocate the “daily limit” for such events among Member Agencies. 959 <br />If adopted, Contractor shall comply with the allocation system. 960 <br />The Agency agrees not to assess Liquidated Damages if Contractor does not meet 961 <br />the ten (10) Business Day requirement if the delay has resulted from (i) the volume 962 <br />of On-Call Bulky Item Collection events being in excess of the “daily limit” for the 963 <br />SBWMA Service Area or Agency, or (ii) the Customer’s request to schedule the event 964 <br />on a date more than ten (10) Business Days in the future. 965 <br />Contractor shall notify the SBWMA and Agency when the daily average number of 966 <br />events reaches one hundred and forty (140) events, where the daily average is 967 <br />calculated on a weekly basis. When this threshold occurs, Parties shall meet and 968 <br />confer to agree on a strategy for handling the volume of Bulky Item Collection Service 969 <br />events. 970 <br />5.06 AGENCY FACILITY ON-CALL BULKY ITEM COLLECTION SERVICE 971 <br />Contractor shall provide each Agency Facility with one annual On-Call Bulky Item 972 <br />Collection service event and shall not bill Agency for such services. Agency may request 973 <br />additional Bulky Item Collection service events; and, Contractor shall bill for the additional 974 <br />service at Agency-approved Charges specified in Attachment Q. The On-Call Bulky Item 975 <br />Collection Service provisions set forth in Section 5.05 shall apply to the On-Call Bulky Item 976 <br />Collection Service provided to Agency Facilities with the following exceptions for 977 <br />frequency and service level/acceptable materials. 978 <br />6.2.B. - Page 38
