<br />REV: 03-16-18 MI <br />ATTY/AGR/2018.054/RECOLOGY OF SAN MATEO <br />Page 70 of 119 <br />facility before their presence is detected, and the Generator cannot be identified or 2884 <br />fails to remove the material after being requested to do so, the Contractor shall 2885 <br />arrange for and/or pay for its proper Disposal. Contractor shall make reasonable 2886 <br />efforts to identify and notify the Generator. The Contractor shall make a good faith 2887 <br />effort to recover the cost of any transportation and Disposal from the Generator, and 2888 <br />the cost of this effort, as well as the cost of Disposal shall be chargeable to the 2889 <br />Generator, if appropriate documentation, as deemed necessary by the Agency, is 2890 <br />provided to the Agency within five (5) Business Days of the occurrence. 2891 <br />In the event Contractor delivers Unpermitted Materials on a frequent or continuous 2892 <br />basis to the Designated Transfer and Processing Facility and the Contractor refuses 2893 <br />to provide for the proper handling and disposition of such Unpermitted Material, the 2894 <br />Operator may provide written notice to Agency of such refusal by Contractor. 2895 <br />D. Reporting, Regulations, and Record Keeping. Contractor shall comply with 2896 <br />emergency notification procedures required by Applicable Laws and regulatory 2897 <br />requirements. Contractor shall notify all appropriate agencies, including the California 2898 <br />Department of Toxic Substances Control and Local Emergency Response Providers 2899 <br />and the National Response Center of reportable quantities of Hazardous Waste found 2900 <br />or observed in Solid Waste, Targeted Recyclable Materials, Organic Materials, 2901 <br />Electronic Waste, Universal Waste, and Construction and Demolition Debris 2902 <br />anywhere within Service Area. In addition to other required notifications, if Contractor 2903 <br />observes any substances which it or its employees reasonably believe or suspect to 2904 <br />contain Hazardous Wastes unlawfully Disposed of or released on any Agency 2905 <br />property, including storm drains, streets or other public rights of way, Contractor will 2906 <br />immediately notify the Agency and SBWMA. 2907 <br />All records required by regulations shall be maintained at the Contractor’s Facility. 2908 <br />These records shall include: waste manifests, waste inventories, waste 2909 <br />characterization records, inspection records, incident reports, and training records. 2910 <br />Contractor shall maintain records showing the types and quantities, if any, of 2911 <br />Hazardous Waste found in Solid Waste, Targeted Recyclable Materials, and Organic 2912 <br />Materials, which was inadvertently Collected from Customers within the Service Area, 2913 <br />but diverted from landfilling. 2914 <br />8.08 COMMUNICATION AND COOPERATION WITH AGENCY AND SBWMA 2915 <br />A. Communications. The Contractor’s general manager shall have e-mail capabilities 2916 <br />to enable the Agency, SBWMA, and the Contractor’s general manager to 2917 <br />communicate via e-mail. Contractor’s general manager shall respond to Agency and 2918 <br />SBWMA email correspondence within twenty-four (24) hours. 2919 <br />B. Monthly Meetings. Upon request from Agency, beginning on the Commencement 2920 <br />Date, and then on a monthly basis thereafter, Contractor shall meet with the Agency 2921 <br />and SBWMA to discuss progress of each active diversion program, quality, and 2922 <br />reliability of Collection services, and compliance with the terms of the Agreement. 2923 <br />SBWMA may attend and participate in these meetings. At each monthly meeting, the 2924 <br />Agency, Contractor, and SBWMA, if attending, shall have the opportunity to present 2925 <br />and discuss proposed changes in service such as changing program requirements or 2926 <br />modifying Collection methods. 2927 <br />C. Inspection by Agency. Agency shall have the right, but not the obligation, to 2928 <br />observe and inspect all of the Contractor’s operations under this Agreement. In 2929 <br />6.2.B. - Page 83
