<br />REV: 03-16-18 MI <br />ATTY/AGR/2018.054/RECOLOGY OF SAN MATEO <br />Page 72 of 119 <br />8.10 BUY-RECYCLED POLICY 2971 <br />The Contractor shall comply with the purchasing requirements described in this Section, 2972 <br />and shall document its on-going compliance with these requirements upon Agency 2973 <br />request. 2974 <br />A. Recycled Paper. The Contractor shall use recycled paper for invoices, Bills, reports, 2975 <br />and public education materials. The recycled paper shall have at least thirty percent 2976 <br />(30%) post-consumer recycled content for uncoated paper and ten percent (10%) 2977 <br />post-consumer recycled content for coated paper based on federal standards. 2978 <br />Contractor shall state on all materials prepared with post-consumer recycled content 2979 <br />the following: “Printed on Recycled Paper.” 2980 <br />B. Re-Refined Motor Oil. Contractor shall be encouraged but not required to use re-2981 <br />refined motor oil for its Collection vehicles. 2982 <br />C. Recycled Plastic. Contractor shall purchase Carts and Kitchen Pails that contain 2983 <br />the minimum post-consumer content as specified in Attachment D. All Carts and 2984 <br />Kitchen Pails shall be one hundred percent (100%) recyclable. 2985 <br />8.11 ANNUAL PERFORMANCE HEARING 2986 <br />A. Objectives. Agency or SBWMA may hold a public performance hearing in April or 2987 <br />May of each Rate Year, at which time Contractor shall be present and shall participate 2988 <br />by making a presentation and responding to questions. Agency or SBWMA shall 2989 <br />convene the hearing to address the positive and negative aspects of Contractor’s 2990 <br />overall performance. The purpose of the hearing may also involve discussion and 2991 <br />review of technological, economic, and regulatory changes in Collection, waste 2992 <br />reduction, Recycling, processing, and Disposal practices that can improve quality of 2993 <br />service; increase waste reduction and diversion; and ensure services are being 2994 <br />provided effectively and economically. Topics for discussion and review at the 2995 <br />performance hearing shall include, but not be limited to: Contractor’s 2996 <br />accomplishments and compliance with various provisions of the Agreement, services 2997 <br />provided, feasibility of providing new services, application of new technologies, 2998 <br />Customer Complaints, possible amendments to this Agreement, developments in the 2999 <br />Applicable Laws and regulations, new initiatives for meeting or exceeding waste 3000 <br />reduction and Recycling goals, regulatory constraints, and Contractor performance. 3001 <br />Agency or SBWMA and Contractor may each select additional topics for discussion 3002 <br />at the performance hearing. 3003 <br />B. Process. Within sixty (60) Days of notification provided by Agency or SBWMA to 3004 <br />Contractor of its intent to conduct a performance hearing, Agency or SBWMA will 3005 <br />submit questions to Contractor pertaining to Contractor’s performance and Contractor 3006 <br />shall submit its written response within thirty (30) Days. Agency or SBWMA and 3007 <br />Contractor shall meet to discuss the questions and Contractor’s response prior to 3008 <br />submittal by Contractor. Agency or SBWMA and Contractor may request from one 3009 <br />another information or documents related to the scheduled public hearing and Agency 3010 <br />or SBWMA and Contractor shall provide such information promptly. 3011 <br />In addition to Contractor’s responses to the questions submitted by Agency or 3012 <br />SBWMA, Contractor may be required to submit a self-assessment report of 3013 <br />Contractor’s performance and information pertaining to the following: 3014 <br />6.2.B. - Page 85
