This provision 3215 <br />shall survive the expiration of this Agreement. 3216 <br />F. Compilation of Information for State Law Purposes. Contractor shall compile 3217 <br />information on amounts of Solid Waste delivered to the Designated Transfer and 3218 <br />Processing Facility and to other locations, as well as other information which the 3219 <br />Agency may reasonably request. 3220 <br />Contractor shall maintain these records for a minimum of ten (10) years after 3221 <br />expiration or earlier termination of the Agreement. Contractor shall provide these 3222 <br />records to Agency (upon request or at the end of the record retention period) in an 3223 <br />organized and indexed manner rather than destroying or Disposing of them. 3224 <br />9.04 GENERAL REPORTING REQUIREMENTS 3225 <br />A. Purpose. Records shall be maintained and retained in forms, on media, and by 3226 <br />methods that facilitate flexible use of data contained in them to structure reports, as 3227 <br />needed. Reports are intended to compile recorded data into useful forms of 3228 <br />information that can be used to, among other things: 3229 <br />1. Evaluate Diversion performance 3230 <br />2. Evaluate Contractor’s performance 3231 <br />3. Monitor Customer participation in Targeted Recyclable Materials and Organic 3232 <br />Materials Collection programs and in other programs using several different 3233 <br />performance measures 3234 <br />4. Monitor changes in the number of Customers and Customers’ service levels 3235 <br />5. Determine needs for adjustment to programs and cost for such changes 3236 <br />6. Evaluate customer service and Complaints 3237 <br />7. Determine and set Contractor’s Compensation and Rates 3238 <br />B. Report Format. Contractor may propose report formats that are responsive to the 3239 <br />objectives and audiences for each report. The format of each report shall be 3240 <br />approved by Agency. The Agency may review and request changes to Contractor’s 3241 <br />report formats and content and Contractor shall not unreasonably deny such 3242 <br />requests. Contractor agrees to submit all reports by e-mail in a format compatible 3243 <br />with the Agency’s software and computers so the Agency can sort and analyze data. 3244 <br />Contractor shall provide a certification statement, under penalty of perjury by the 3245 <br />responsible Contractor official, that the report being submitted is true and correct to 3246 <br />the best knowledge of such official after their reasonable inquiry. 3247 <br />C. Submittal Schedule and Instructions. Contractor shall submit monthly reports 3248 <br />within fifteen (15) Days after the end of the reporting month, quarterly reports within 3249 <br />thirty (30) Days after the end of the reporting quarter, and annual reports within forty-3250 <br />five (45) Days after the end of the reporting year. Contractor shall submit (via e-mail) 3251 <br />all reports to the person(s) designated by SBWMA and Agency. Each quarterly report 3252 <br />shall be in lieu of the monthly report for the third month of the quarter; thus, Contractor 3253 <br />shall submit a total of thirteen (13) periodic reports per year: eight (8) monthly reports, 3254 <br />four (4) quarterly reports, and one (1) annual report. 3255 <br />6.2.B. - Page 91
