The refusal or failure of Contractor to file any required reports, or 3256 <br />to provide required information to Agency, or the inclusion of any materially false or 3257 <br />misleading statement or representation by Contractor in such report shall be deemed 3258 <br />a Contractor default as described in Section 14.01 subject to the notice and cure 3259 <br />provisions of that section and shall subject Contractor to all remedies which are 3260 <br />available to the Agency under the Agreement or otherwise. 3261 <br />E. Accuracy of Reports. The failure of Contractor to file accurate and timely reports, 3262 <br />proposal(s), information, or correspondence to Agency or SBWMA, or the inclusion 3263 <br />of any inaccurate or misleading data, statement or representation by Contractor in 3264 <br />such report(s), proposal(s), information, or correspondence to Agency or SBWMA, 3265 <br />shall be subject to Liquidated Damages as set forth in Attachment J. In addition, the 3266 <br />inclusion of any materially false or misleading statement or representation by 3267 <br />Contractor in such report shall be deemed a Contractor default as described in 3268 <br />Section 14.01 subject to the notice and cure provisions of that Section and shall 3269 <br />subject Contractor to all remedies which are available to the Agency under the 3270 <br />Agreement or otherwise. 3271 <br />F. Source Files. Contractor shall provide the SBWMA the following information: (i) with 3272 <br />each monthly or quarterly report, a spreadsheet provided by Operator showing all 3273 <br />Tonnages Collected by Contractor and delivered to the Shoreway Recycling and 3274 <br />Disposal Center from Member Agencies during the reporting month, listed separately 3275 <br />by Member Agency, material type, and Service Sector; (ii) with each monthly or 3276 <br />quarterly report, a spreadsheet containing the information required by Sections 3277 <br />9.06.B, 9.06.D, and 9.06.E; and, (iii) with each annual report, a spreadsheet 3278 <br />containing the information required by Section 9.07.B. Such information need not be 3279 <br />included in the published reports provided to Agency. 3280 <br />9.05 MONTHLY REPORTS 3281 <br />Monthly reports shall present the information described in this Section in a format agreed 3282 <br />upon by the Agency. 3283 <br />A. Tonnage Information. Contractor shall provide the Tonnage information requested 3284 <br />below by Service Sector on a monthly and year-to-date basis, with a comparison to 3285 <br />the prior year. However, the Agency reserves the right to request the monthly 3286 <br />Tonnage data by route. 3287 <br />1. Solid Waste. Total Solid Waste Tonnage Collected and Disposed by Service 3288 <br />Sector. 3289 <br />2. Targeted Recyclable Materials Services. Total Targeted Recyclable Materials 3290 <br />Tonnage Collected and delivered for processing by Service Sector listed 3291 <br />separately by material type Collected (e.g., Single-Stream Recyclable Materials, 3292 <br />Source Separated cardboard, Source Separated paper, Used Motor Oil, Used 3293 <br />Motor Oil Filters, etc.). 3294 <br />3. Organic Materials Services. Total Organic Materials Tonnage Collected and 3295 <br />delivered for processing by Service Sector listed separately by material type 3296 <br />(e.g., Plant Materials, Food Scraps, or Organic Materials). 3297 <br />B. Diversion Level. Contractor shall provide the monthly and year-to-date Calculated 3298 <br />Overall Diversion Level, the monthly and year-to-date Residential Diversion Level, 3299 <br />6.2.B. - Page 92
