<br />~/~/9 <br /> <br />,. <br /> <br />COUNTY OF SAN MATEO <br /> <br />Interdepartmental Correspondence <br /> <br />DATE: <br /> <br />FEBRUARY 11,1988 <br /> <br />TO: <br /> <br />BOARD OF SUPERVISORS <br /> <br />FROM: <br /> <br />DISTRICT ATTORNEY <br /> <br />SUBJECT: <br /> <br />MODIFICATION OF JOINT POWERS AGREEMENT <br /> <br />RBCOMMENDATIdN <br /> <br />That your Board adopt the resolution approving the proposed <br />amendments to the joint powers agreement which creates the San <br />Mateo County Narcotics Task Force and direct transmission of the <br />amended agreement to all other member agencies for approval. <br /> <br />DISCUSSION <br /> <br />In March 1985 your Board approved adoption of a joint powers <br />agreement which creates ,the San Mateo County Narcotics Task <br />Force. Subsequent to your Board's approval of the agreement, all <br />twenty cities within the county approved the agreement and are <br />now members of the task force. <br /> <br />During the past 2-1/2 years of operation of the task~orce, it <br />has become apparent that certain minor changes shoul~ be made to <br />the joint powers agreement. Included among those changes is a <br />provision to allow reimbursement to any city which chooses to <br />contribute manpower, the value of which exceeds the formula <br />financial contribution which would be required of that city. <br /> <br />There are sufficient monies within the task force budget to <br />provide for reimbursement for any overmatch. The rebate policy <br />is contained in section 7(f) of the joint powers agree~ent. <br /> <br />The next amendment deals with the disposition of property in <br />event of termination of the joint powers agreement. Section <br />of the amended agreement provides for distribution of assets <br />proportion to the contributions to the task force during the <br />of the task force.' , <br /> <br />the <br />14 <br />in <br />life <br /> <br />The next amendment to the agreement involves section 15 - <br />Termination. Rather than provide for a specific termination <br />date, it is believed that the task force has been so successful <br />that it should continue until affirmative action to terminate is <br />ta]çen by member agencies. Any member agency may terminate its <br />relationship with the task force by failure to provide the <br />contributions required by the agreement. <br />
