NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br />Section 1. The Commission, having independently heard, considered, and weighed all <br />the evidence in the record, finds that the above recitals are accurate and constitute findings in <br />this matter and, together with the staff report and the application materials, including without <br />limitation the Draft SEIR, development plan, and all other documents, reports, studies, <br />memoranda, maps, oral and written testimony, and materials in the City's file for the applications <br />and the Project, and all adopted City planning documents relating to the Project and the property <br />including the City's General Plan, Municipal Code, Zoning Ordinance, the Downtown Precise <br />Plan, and other applicable City laws and regulations, and all associated approved and certified <br />environmental documents, have together served as an adequate and appropriate evidentiary <br />basis for the findings and actions set forth in this Resolution. <br />Section 2. CEQA. The Commission finds, based on its independent judgment and <br />analysis, that: <br />a. The Draft SEIR, including all technical background reports and appendices, has <br />adequately analyzed potential impacts of the 851 Main Street Project and provides <br />sufficient information for purposes of providing a recommendation on the Project. The <br />Commission further certifies that it has reviewed and considered the information in the Draft <br />SEIR; and <br />b. Pursuant to CEQA Guidelines section 15091(e), the documents and other materials <br />that constitute the record of proceedings upon which the Commission has based its <br />determinations are located in and may be obtained from the Office of the City Clerk at <br />1017 Middlefield Road Redwood City California The City Clerk is the custodian of records <br />for all matters before the City; and <br />Section 3. General Plan Amendment - Findings: In the exercise of its independent <br />judgment, and with the affirmative vote of at least four (4) members, the Commission finds that: <br />a. The Project, including the General Plan Amendment revising the non-residential <br />development cap, is consistent with the goals and policies of the City's 2010 <br />General Plan and appropriately implements the Mixed Use - Downtown General <br />Plan land use designation, as set forth in the staff report and analyses referenced <br />therein. <br />b. The Project, including the proposed General Plan text amendment to increase the <br />development cap for non-residential development within downtown will not create <br />conditions that would be detrimental to the public health, safety and general welfare. <br />c. Through the adoption of the SEIR and its associated Mitigation Monitoring Plan <br />(MMRP), all identified impacts associated with the General Plan amendment to <br />increase the non-residential development cap would be mitigated to a less -than - <br />significant level. <br />Section 4. General Plan Amendment - Recommendation: In the exercise of its <br />independent judgment, and with the affirmative vote of at least four (4) members, the Commission <br />recommends to the City Council that the text of the General Plan Mixed Use - Downtown land use <br />designation be amended as follows: <br />ATTY/RESO.0019/PC RESO RECOMMENDING APPROVAL OF GENERAL PLAN — 851 MAIN STREET <br />REV: 03-15-18 PR <br />Page 3 of 6 <br />
