<br />ATTY/ORD.455/RC ORD AUTHORIZING THE DEFERRAL OF FEES <br />REV: 03-20-18 JS <br />Page 1 of 1 <br />ORDINANCE NO. ______ <br /> <br />ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />REDWOOD CITY AUTHORIZING DEFERRALS OF PAYMENT <br />FOR CITY FEES ASSOCIATED WITH DEVELOPMENT <br />PROJECTS <br /> <br />THE COUNCIL OF THE CITY OF REDWOOD CITY DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> Section 1. All fees associated with the development of real property, other <br />than the Parks Impact Fee, including, without limitation, application fees, impact <br />fees, permit fees, water and sewer connection fees, and inspection fees <br />(“Development Fees”) shall be due at the time established by applicable ordinance, <br />resolution, or policy. Notwithstanding the forgoing, payment of any Development <br />Fees may be deferred to the date the certificate of occupancy is issued for the <br />development, provided the owner of the real property for which the Development <br />Fees are required enters into an agreement with the City prior to the due date for <br />applicable Development Fees. The agreement shall provide that a certificate of <br />occupancy shall not be issued until the Development Fees are paid. The <br />agreement shall also provide that, in any action to collect the Development Fees <br />or any portion thereof, the City shall be entitled to all of its costs of enforcement <br />and collection, including reasonable attorney's fees. Deferrals and accompanying <br />agreements under this Section shall only be approved by [AS1]the City Council. Any <br />deferral granted pursuant to this Section shall be consistent with the requirements <br />of Government Code Section 66007. <br /> <br /> Section 2. The City Council hereby finds that this Ordinance is in the public <br />interest. <br /> <br /> Section 3. Adoption of this Ordinance is not a project within the meaning <br />of section 15378 of the CEQA Guidelines because it has no potential for resulting <br />in either a direct or a reasonably foreseeable indirect physical change in the <br />environment. <br /> <br />Section 4. If any section, subsection, clause or phrase of this Ordinance <br />Amendment is for any reason held to be invalid, such decision shall not affect the <br />validity of the remaining portion or sections of the Ordinance. The City Council of <br />the City of Redwood City hereby declares that it would have adopted the Ordinance <br />and each section, subsection, sentence, clause or phrase thereof irrespective of <br />the fact that any one or more sections, subsections, sentences, clauses or phrases <br />be declared unconstitutional. <br /> <br />Section 5. This Ordinance shall go into effect thirty (30) days after the date <br />of its passage and adoption. <br />* * * <br />7.A. - Page 10
