<br />(c) <br /> <br />(d) <br /> <br />(e) <br /> <br />(f) <br /> <br />CGM:wg: 7/7/75 <br /> <br />In required front yards, or within 15 feet of <br />any street right of way, whichever is greater, <br />the maximum height shall be three feet above <br />the surface of the ground. <br /> <br />In required rear yards, or within 25 feet of the <br />rear lot line, whichever is greater, but excluding <br />any portion of a lot within 15 feet of any street <br />right of way, the maximum height shall be seven <br />feet above the surface of the ground. <br /> <br />In required intervening interior side yards the <br />maximum height shall be 76 inches above the <br />surface of the ground. <br /> <br />In the rear half of any lot, open wire fences may <br />exceed 76 inches in height provided they are not <br />closer than 15 feet to any street side lot line <br />of any corner lot. <br /> <br />(g) <br /> <br />Whenever the provisions of this section establish <br />a maximum height limit of 76 or more inches for <br />a fence, such height may be increased to ten feet <br />in any district except the PO, AG, and any R <br />Distr ict. <br /> <br />(h) <br /> <br />All fences and walls, existing upon the effective <br />date of this section, which meet the standards <br />and provisions for fences and walls as provided <br />for herein shall not be subject to subsection (a). <br />All fences and walls, existing upon the effective <br />date of this section, which do not meet the <br />standards and provisions for fences and walls <br />as provided for herein shall comply with the pro- <br />visions hereof within three years of the effective <br />date of this section. The Commission may authorize <br />a time extension in specific instances for compli- <br />ance with the provisions of this section upon <br />application therefor by granting a Use Permit. <br />Such Use Permit for a time extension shall only be <br />granted if the applicant demonstrates: <br /> <br />(1) <br /> <br />That the granting of a time extension <br />will not be detrimental to persons or <br />property in the neighborhood. <br /> <br />(2 ) <br /> <br />That the granting of a time extension <br />is not contrary to the intent of this <br />Ordinance. <br /> <br />(3) <br /> <br />That the granting of a time extension <br />will alleviate a hardship on the <br />applicant. <br /> <br />The fee for such Use Permit shall be the same as, <br />and the application therefor shall be on the same <br />form as that required for a Fence Permit. <br /> <br />-6- <br />
