Security Requirements –The City Council directed staff to revise the provisions for on- <br />site security personnel to be consistent with State regulations. The proposed Municipal <br />Code ordinance requires delivery centers to have security personnel in accordance with <br />State regulations. The State Bureau of Cannabis Control’s (BCC) emergency regulation <br />Section 5045, titled ‘Security Personnel,’ states: <br />A retail licensee or microbusiness licensee that is engaged in retail sale <br />shall hire or contract for security personnel to provide security services for <br />the licensed retail premises. All security personnel hired or contracted for <br />by the licensee shall comply with Chapters 11.4 and 11.5 of Division 3 of <br />the Business and Professions Code. <br />In addition, BCC emergency regulation Section 5414 clearly provides that Type-9 non- <br />storefront retailer licensees (the State’s terminology for cannabis delivery centers) must <br />comply with all the requirements applicable to Type 10-Retailer licensees, except for <br />those provisions related to public access to the premises. As a result, the proposed <br />ordinance will require security personnel for the delivery centers as required by State <br />law but will not require security personnel for the nursery facilities as this is not required <br />by State law. <br />Nursery Uses – The City Council asked for clarification about the presence or use of <br />mature plants in nurseries. State law includes two provisions for nursery uses that <br />clarifies how mature plants are to be handled and designated within nursery facilities. <br />These clarifying provisions are incorporated into the proposed Redwood City’s <br />ordinances for nursery facilities to be consistent with state law. The proposed <br />ordinances provide a nursery producing seed for distribution may contain mature plants, <br />but all products, except seed, derived from these plants are prohibited from entering the <br />commercial distribution chain. The proposed ordinances further provide that a nursery <br />may maintain a research and development area for the cultivation of mature plants, but <br />all products derived from these plants are prohibited from entering the commercial <br />distribution chain. <br />In addition to these modificaitons to the Ordinances, additional items were discussed at <br />the April 9, 2018 public hearing. <br />Background Checks - Questions were raised during the public hearing about whether <br />a prior criminal conviction would prevent an individual from obtaining a City cannabis <br />business permit or participating in cannabis busines operations in Redwood City. There <br />are two situations in which background checks are completed: <br />1. Application for a Redwood City Cannabis Business Permit: The City’s proposed <br />application and review procedures for a cannabis business permit exceed State <br />regulations.
