<br />Mr. Parviz Mokhtari <br />Mr. Jon Lynch <br />Cordilleras Creek Studies <br />November 22, 2005 <br />Page 3 of 4 <br /> <br />EXCLUSIONS <br /> <br />Additional work that does not fall within our scope of services described <br />above includes: <br /> <br />1. <br /> <br />Survey is excluded from the Scope of Services, but can be provided as <br />an additional service. Construction staking is specifically excluded. <br /> <br />2. <br /> <br />Potholing is excluded from the Scope of Services. Because grades are <br />being restored to historic levels, it is anticipated that no utilities have <br />encroached within the historic flow path. <br /> <br />3. <br /> <br />FEMA processing is excluded from the scope of services. Since grades <br />are being restored to FEMA levels, no needs for processing with <br />FEMA are anticipated. <br /> <br />4. <br /> <br />Major revisions to work or drawings that are substantially complete, <br />provided such revisions are not caused by the actions of BKF. Also <br />meetings in excess of those outlined above or additional costs incurred <br />due to substantial project delays. <br /> <br />5. <br /> <br />Retention of outside consultants for landscaping, electrical, structural, <br />biological, geotechnical, EIR preparation and other services not <br />traditionally completed by BKF Engineers are excluded from this <br />Scope of Services. We assume that the Cities, if required, will provide <br />these specialty services. <br /> <br />6. <br /> <br />Environmental reviews are excluded from this scope of the work. This <br />includes meetings with the Corps of Engineers, Fish and Wildlife, Fish <br />and Game, and other environmental review Agencies, except as noted <br />in Task 5. <br /> <br />7. <br /> <br />The Scope of Services is complete with preparation of the pennit-Ievel <br />construction documents. If the Cities requests additional work, <br />including Contract Documents, this is excluded from this Scope of <br />Services, but can be provided as an additional service. <br /> <br />8. <br /> <br />Pennitting fees are excluded from this Scope of Services. <br /> <br />9. <br /> <br />The project is related to the removal of sediment from the Creek to <br />restore an historic flow path. Providing a specified level of flood <br />control protection is excluded from this project. <br /> <br />~ <br />
