<br />OAK #4843-3885-9090 v10 11 <br />ATTY/AGR/2018.094/STRADA DOCKTOWN DEVELOPMENT AGREEMENT <br />REV: 05-03-18 PR <br />Page 11 of 93 <br />“Connection Fees” means those fees charged by City or by a utility provider to <br />utility users as a cost for connecting to water, sanitary sewer, and other applicable utilities. <br />“County Authorization” is defined in Section 3.3C. <br />“County/Developer Segments In Lieu Payment” is defined in Section 3.3D. <br />“County Segment Outside Date” is defined in Section 3.3C. <br />“Default” is defined in Section 12.1. <br />“Default Escalator” means the Engineering News Record Construction Cost <br />Index (CCI) for San Francisco, California. <br />“Developer” means 1548 Maple, LLC, a Delaware limited liability company, and <br />its permitted assignees and successors-in-interest under this Agreement. <br />“Developer In Kind Contributions” is defined in Section 6.2A. <br />“Developer Work Product” is defined in Section 3.3E. <br />“Development Agreement Law” is defined in Recital A. <br />“Effective Date” is defined in Section 4.1. <br />“Eligible Existing Impact Fees” is defined in Section 6.2A. <br />“Environmental Impact Report” and “EIR” are defined in Recital E. <br />“Exactions” means exactions that may be imposed by City as a condition of <br />developing the Project, including requirements for acquisition, dedication, or reservation of land; <br />and obligations to construct on-site or off-site public and private infrastructure improvements such <br />as roadways, utilities, or other improvements necessary to support the Project, whether such <br />exactions constitute subdivision improvements, mitigation measures in connection with <br />environmental review of the Project, or impositions made under Applicable City Regulations. For <br />purposes of this Agreement, Exactions do not include Impact Fees. <br />“Existing Approvals” is defined in Recital F. <br />“Existing Impact Fees” means those Impact Fees of general applicability within the <br />City that have been adopted by City and are in full force and effect as of the Effective Date, <br />including the Housing Impact Fee, the Parks Impact Fee, the Transportation Impact Fee, the Water <br />Impact Fee, the Sewer Impact Fee and the Infrastructure Improvement Fee. <br />“Extension Criteria” is defined in Section 4.2C. <br />“Extension Request” is defined in Section 4.2C. <br />6.4.B. - Page 36
