OAK #4843-3885-9090 v10 12 ATTY/AGR/2018.094/STRADA DOCKTOWN DEVELOPMENT AGREEMENT REV: 05-03-18 PR Page 12 of 93 “Force Majeure Delay” is defined in Section 4.2E. “General Plan” means the General Plan of the City in effect as of the Effective Date. “House Price Index” is defined in Section 4.2E. “Housing Impact Fee” means the fee paid under Municipal Code Chapter 18, Article XVII by developers of residential development projects to mitigate the impacts that such developments have on the demand for affordable housing in the City. “Infrastructure Improvement Fee” is defined in Section 3.7. “Impact Fees” means the monetary fees and impositions, other than taxes and assessments, charged by City in connection with a development project for the purpose of defraying all or a portion of the cost of mitigating the impacts of a development project or development of the public facilities and services related to a development project, including the Housing Impact Fee, Transportation Improvement Impact Fee and any other City “fee” as that term is defined by Government Code Section 66000(b). For purposes of this Agreement, a monetary fee or imposition that meets both the definition of an Impact Fee and the definition of an Exaction will be considered an Impact Fee. “Impact Fee Lock Period” is defined in Section 6.1A(1). “Initial Term” is defined in Section 4.2B. “Insubstantial Amendment” is defined in Section 9.2. “Litigation Challenge” is defined in Section 10.6B. “LLMD” is defined in Section 3.2B. “Major Amendment” is defined in Section 9.3. “Maple Frontage Parking” is defined in Section 3.9. “Maple Street Vacation Area” is defined in Recital D. “Maritime Community Payment” is defined in Section 3.5. “MMRP” is defined in Recital E. “Mortgage” is defined in Section 8.1. “Mortgagee” is defined in Section 8.1. “Municipal Code” means the Municipal Code of the City of Redwood City in effect as of the Effective Date. 6.4.B. - Page 37
