CEQA: In the exercise of its independent judgement, the City Council <br />finds that the project is exempt from the California Environmental Quality Act (CEQA) <br />pursuant to CEQA Guidelines Section 15332 (Class 32 - "Infill Development Projects"), <br />as further explained in the CEQA Memorandum, because: <br />a. The project is consistent with the applicable general plan designation and <br />all applicable general plan policies as well as with applicable zoning <br />designation and regulations; and <br />b. The proposed development occurs within city limits on a project site of no <br />more than five acres substantially surrounded by urban uses; and <br />c. The project site has no value as habitat for endangered, rare, or threatened <br />species; and <br />d. Approval of the project would not result in any significant effects related to <br />traffic, noise, air quality, or water quality; and <br />e. The site can be adequately served by all required utilities and public <br />services. <br /> <br />Pursuant to Guidelines section 15091(e), the documents and other materials that <br />constitute the record of proceedings upon which the City Council has based its decision <br />are located in and may be obtained from, the Office of the City Clerk at 1017 Middlefield <br />Road, Redwood City California. The City Clerk is the custodian of records for all matters <br />before the City. <br /> <br />Section 3. Planned Community Permit DPC2016-05: In the exercise of its <br />independent judgment, the City Council finds that: <br /> <br />a. The Project and improvements proposed by Planned Community Permit <br />DPC2016-05 are consistent with, conform to the intent of, and will <br />appropriately implement the North Main Street Precise Plan for the <br />353 Main Street project; and <br /> <br />b. The establishment, maintenance and operation of the project and <br />improvements proposed by Planned Community permit DPC2016-05 <br />will not, under the circumstances of this particular case, be detrimental <br />to the health, safety, peace, morals, or general welfare of persons <br />residing or working in the neighborhood of the project, or be <br />detrimental or injurious to property or improvements in the <br />neighborhood of the project, or to the general welfare of the City, <br />because the project has been found to be consistent with the <br />community goals established in the City's General Plan and Zoning <br />Ordinance; and <br />7.B. - Page 29
