Appeal <br /> <br />Contention: Additional CEQA analysis is required. <br /> <br />The Project is ineligible for CEQA Class 32 Exemption because <br />the amount of excavation and shallow water table constitute <br />unusual circumstances. <br /> <br />City Response: No additional CEQA analysis is required. <br /> <br />•The City’s analysis found that the Project meets the Class 32 <br />findings and is exempt from further CEQA analysis. <br />•The project is also subject to the NMPP MMRP, which <br />includes air quality mitigation relating to construction <br />activities, stormwater pollution and management, and <br />construction noise mitigation.
