<br />CES:djm '/16/90 (050/27) <br /> <br />RES 0 L UTI 0 N <br /> <br />MAY:2\ 1990 <br />N 0.11 288 <br /> <br />ORiGINAL <br /> <br />RESOLUTION SUMMARILY VACATING A PUBLIC SERVICE <br />EASEMENT, APPROVING AND AUTHORIZING ACCEPTANCE OF GRANT <br />OF EASEMENT IN EXCHANGE THEREFORE, AUTHORIZING AND <br />DIRECTING EXECUTION OF EASEMENT GRANT DEED AND <br />QUITCLAIM DEED AND PROVIDING FOR RECORDING THEREOF <br /> <br />WHEREAS, pursuant to the provisions of Chapter 4 (commencing <br /> <br />with ~8330), Part 3, Division 9 of the Streets and Highways Code <br /> <br />of the State of California, this Council may summarily vacate a <br /> <br />public service easement, if such easement has been superseded by <br /> <br />relocation and there are no other public facilities located <br /> <br />within said easement; and <br /> <br />WHEREAS, a public service easement previously granted as <br /> <br />Parcel II by Leslie Properties, Inc., a California corporation, <br /> <br />to City, pursuant to that certain Grant of Easements, recorded on <br /> <br />January 17, 1968, in Book 5419 at page 62, in the Official <br /> <br />Records of San Mateo County, California, located in the City of <br /> <br />Redwood City, County of San Mateo, State of California, described <br /> <br />in Exhibit "B", attached hereto and incorporated herein by this <br /> <br />reference, shall no longer be required for public uses provided <br /> <br />that said easement be relocated; and <br /> <br />WHEREAS, the owner of record of the property affected <br /> <br />thereby shall simultaneously convey to City a deed of easement <br /> <br />over that certain property in the City of Redwood City, County of <br /> <br />San Mateo, State of California, described and depicted in Exhibit <br /> <br />"A", attached hereto and incorporated herein by this reference in <br /> <br />exchange for the easement to be vacated; and <br />
