On December 28, 2005, the Parties executed Agreement for Professional <br /> Engineering and Design Services with Moffatt & Nichol in the amount of $106,764.00; <br /> and <br /> B. On January 12, 2009, the Parties executed Amendment No. 1 to <br /> Agreement for Professional Engineering and Design Services in the amount of <br /> $49,301.00; and <br /> C. On October 12, 2009, the Parties executed Amendment No. 2 to <br /> Agreement for Professional Engineering and Design Services in the amount of <br /> $21,545.00; and <br /> C. On December 30, 2009, the Parties executed Amendment No. 3 to <br /> Agreement for Professional Engineering and Design Services in the amount of <br /> $35,230.00; and <br /> D. The Parties have negotiated and agreed to amendments attached to and <br /> incorporated in by reference as Exhibit "A," Scope of Services and Fee. <br /> NOW, THEREFORE, in consideration of these recitals and the mutual covenants <br /> contained herein, the Parties agree as follows: <br /> 1. In addition to those services contained in the Agreement, as may have <br /> been amended from time to time, Consultant will provide those services described in <br /> Exhibit "A." With this Amendment, the total a��Agreement amount shall not exceed <br /> Three Hundred Fifty Six Thousand Three Hundred Forty and 00/100 Dollars <br /> ($356,340.00). <br /> 2. City will pay Consul#ant for all work associated with those services <br /> described in Exhibit "A" on a time and materials basis not-to-exceed One Hundred Forty <br /> Three Thousand Five Hundred and 00/100 Dollars ($143,500.00), for an aggregate <br /> amount of $356,340.00.
