05/21/2018 <br />WHEREAS, on May 21, 2018 the City Council conducted a duly noticed de <br />novo public hearing in accordance with all applicable requirements of the State <br />Planning and Zoning Law, the City Zoning Ordinance and the North Main Street <br />Precise Plan, to consider the appeal of the Planning Commission's approval of the <br />Project, and received and considered documentary evidence on the appeal and <br />application; and <br />WHEREAS, the City Council considered whether the Project is categorically <br />exempt from the requirements of the California Environmental Quality Act (CEQA), <br />pursuant to CEQA Guidelines Section 15332 (Class 32 - "Infill Development Projects") <br />as explained in the CEQA compliance memorandum attached to the staff report ("CEQA <br />Memorandum"), along with the previously adopted Mitigated Negative Declaration and <br />Mitigation Monitoring and Reporting Checklist for the North Main Precise Plan, the staff <br />reports, oral and written, and testimony and materials presented by all those wishing to <br />be heard on this Project at the noticed public hearing on this matter; and <br />WHEREAS, the City Council determined that the proposed Planned <br />Community Permit, Density Bonus including a height concession, and Affordable <br />Housing Plan would further the purposes of and appropriately implement the <br />City of Redwood City General Plan, the North Main Street Precise Plan, and <br />applicable provisions of the Redwood City Municipal Code and Zoning <br />Ordinance. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF REDWOOD CITY AS FOLLOWS: <br />Section 1. The City Council, having independently heard, considered and <br />weighed all the evidence in the record, including evidence presented by City staff, <br />the Applicant, the Appellants and members of the public, and being fully informed <br />of the Project, the Planning Commission's decision, and the appeal, finds that the <br />Appellant has not shown, based on evidence in the record, that the Planning <br />Commission's decision was made in error, that there was an abuse of <br />discretion by the Planning Commission, that the Planning Commission's decision <br />was otherwise improper, or that the City's notices, agendas, and appeal <br />procedures were unlawful in any manner, and, in the exercise of its independent <br />judgment , hereby denies the appeal and approves the Planned Community <br />Permit , Density Bonus including a height concession, and Affordable Housing <br />Plan based on the following findings and subject to the Conditions of Approval set <br />forth below. This determination is based on the entire record, including without <br />limitation the application materials, the N M PP, NMPP Mitigated Negative <br />ATTY/RESO.0041/CC RESO DENYING THE APPEAL FOR 353 MAIN STREET RESO.
