<br />by courts in cases where such decisions are considered binding precedents in <br />the State of California (the "State"), and decisions of federal courts applying the <br /> <br />laws of the State (collectively "Laws"). Tenant shall comply with all applicable <br />Laws regarding the physical condition of the Premises, but only to the extent that <br /> <br />the applicable Laws pertain to the particular manner in which Tenant uses the <br />Premises or the particular use to which Tenant puts the Premises, if different <br /> <br />from that permitted under Section 1.3 of this lease. Tenant shall also comply <br />with all applicable Laws which do not relate to the physical condition of the <br /> <br />Premises and with which only the occupant can comply, such as laws governing <br />maximum occupancy, workplace smoking, VDT regulations, and illegal business <br /> <br />operations, such as gambling. If Tenant's particular use of or alteration to the <br />Premises or its change in the use of the Premises obligates either Landlord or <br /> <br />Tenant to expend money in order to bring the Premises and/or any area of the <br />Building into compliance with Laws, Tenant shall bear all costs ("Code Costs") of <br /> <br />bringing the Premises and/or Building into compliance with Laws, whether such <br />Code Costs are related to structural or nonstructural elements of the Premises or <br /> <br />Building. <br />3.3 <br /> <br />Services and Utilities. <br /> <br />Landlord shall provide the following services and utilities, the cost <br />of which shall be included in Operating Expenses and reimbursed to Landlord in <br /> <br />accordance with Section 2.3: <br /> <br />(a) <br /> <br />Electricity for standard office lighting fixtures and equipment <br /> <br />and accessories customary for offices (up to 280 hours per month) where: (1) <br />the connected electrical load of all the same does not exceed an average of four <br /> <br />(4) watts per square foot of the Premises (or such lesser amount as may be <br />available, based on the safe and lawful capacity of the existing electrical circuit(s) <br /> <br />(~J¡.~. <br />l\l <br />V <br />
