<br />misconduct. <br /> <br />5.10 Release of Claims. <br />Notwithstanding anything to the contrary in Sections 5.8 and 5.9, <br /> <br />the Parties release each other from any claims either party ("Injured Party") has <br />against the other, but only to the extent the claim or liability is covered by the <br /> <br />Injured Party's insurance or the insurance the Injured Party is required to carry <br />under this Article 5, whichever is greater. <br /> <br />5.11 <br /> <br />Limitation Liability Upon Transfer. <br /> <br />In case landlord or any successor owner of the Property or the <br /> <br />Building shall conveyor otherwise dispose of any portion thereof to another <br />person or entity ("Person") (and nothing herein shall be construed to restrict or <br /> <br />prevent such conveyance or disposition), such other person shall thereupon be <br />and become landlord hereunder and shall assume and be liable for all obligations <br /> <br />of this Lease to be performed by landlord which first arise after the date of <br />conveyance, including the return of any Security Deposit; and, provided the <br /> <br />successor owner shall have assumed such obligations, in writing, Tenant shall <br />attorn to such other Person, and Landlord or such successor owner shall, from <br /> <br />and after the date of conveyance, be free of all liabilities and obligations <br />hereunder not then incurred. <br /> <br />5.12 Limitations on Landlord's Liability. <br />The liability of landlord to Tenant for any default by Landlord under <br /> <br />this Lease or arising in connection herewith or with Landlord's operation, <br /> <br />management, leasing, repair, renovation, alteration, or any other matter relating <br /> <br />to the Property or the Premises, shall be limited to the interest of Landlord in the <br />Property (and the proceeds thereof) unless the interest in the Property is less <br /> <br />than insurance that may cover the claim, in which case, the amount of insurance <br /> <br />¿^it~ <br />;I <br />
