<br />by landlord subsequent to any Event of Default or breach hereof shall not be <br /> <br />deemed a waiver of any preceding Event of Default or breach other than the <br />failure to pay the particular Rent so accepted, regardless of Landlord's <br /> <br />knowledge of any breach at the time of such acceptance of Rent. Landlord shall <br />not be deemed to have waived any term, covenant, or condition of this lease, <br /> <br />unless Landlord gives Tenant written notice of such waiver. <br />7.2.2 Landlord's Right to Cure. If an Event of Default occurs in <br /> <br />the performance by Tenant of any of its obligations under this Lease, landlord <br />may (but shall not be obligated to), without waiving such default, perform the <br /> <br />same for the account and at the expense of Tenant. Tenant shall pay landlord <br />all costs of such performance promptly upon receipt of a bill therefor. <br /> <br />7.3 <br /> <br />Damages. <br />Should landlord elect to terminate this Lease under the provisions <br /> <br />of Section 7.2 above, Landlord may recover as damages from Tenant the <br />following: <br /> <br />(a) <br /> <br />Past Rent: The worth at the time of the award of any unpaid <br /> <br />Rent which has been earned at the time of termination; plus <br /> <br />(b) <br /> <br />Rent Prior to Award: The worth at the time of the award of <br /> <br />the amount by which the unpaid Rent which would have been earned after <br />termination until the time of award exceeds the amount of such rental loss that <br /> <br />Tenant proves could have been reasonably avoided; plus <br /> <br />(c) <br /> <br />Rent After Award: The worth at the time of the award of the <br /> <br />amount by which the unpaid Rent for the balance of the term after the time of <br />award exceeds the amount of the rental loss that Tenant proves could have been <br /> <br />reasonably avoided; plus <br /> <br />(d) <br /> <br />Proximately Caused Damages: Any other amount <br /> <br />P¡~LV <br />
