<br />ix) Developer shall periodically prepare and distribute Change Order Reports <br />during the Construction Phase, beginning after the first change order is approved. The <br />report shall list all approved change orders by number, a brief description of the change <br />order work, a proposed assignment of responsibility for the cost of the change order, the <br />cost established in the change order and percent of completion of the change order <br />work. <br /> <br />C. <br /> <br />Construction Administration <br /> <br />i) Before allowing any Contractor to begin work, Developer shall verify that <br />the Contractor has secured the required permits, bonds, insurance, labor affidavits and <br />waivers. <br /> <br />ii) Developer shall provide all testing and inspection services required for the <br />Project through appropriate Consultants acceptable to City and Agency. <br /> <br />iii) Developer shall coordinate all technical inspection and testing required for <br />the Project. Developer shall be provided a copy of all inspection and testing reports on <br />the date of the inspection or test. <br /> <br />iv) Developer shall review proposed substitutions for specified products or <br />equipment for the Streetscape Improvements and Street Modifications with the design <br />consultants and shall prepare and present recommendations to the City and Agency on <br />acceptance of the proposed substitution in report form. Developer shall not allow the <br />contractors to make any substitutions that will affect the Streetscape Improvements and <br />Street Modifications without written approval from the City and Agency. <br /> <br />v) Developer shall review the contents of requests for changes to the <br />contract time or price submitted by a Contractor, assemble information concerning the <br />request and endeavor to determine the cause of the requests. If Developer believes <br />that the requested change may affect the Project schedule and/or require the City and <br />Agency to increase their financial contributions to the Project, Developer shall prepare <br />and submit to the City and Agency a written analysis of the proposed change and a <br />recommendation with respect to acceptance of the request. <br /> <br />vi) Developer shall review the payment applications submitted by each <br />Contractor and Consultant and determine whether the amount requested reflects the <br />progress of the Contractor's or Consultant's work. Developer shall make appropriate <br />adjustments to each payment application and shall prepare and forward to the City and <br />Agency a progress payment report. The report shall state the total contract price, <br />payments to date, current payment requested, retainage and actual amounts owed for <br />the current period. Included in this report shall be a Certificate of Payment that shall be <br />signed by the Developer and delivered to the City and the Agency. <br /> <br />vii) Developer shall establish and implement a program to monitor the quality <br />of the construction, and shall inspect the progress of the course of construction of the <br />Streetscape Improvements and Street Modifications, and verify that the construction is <br />being carried out substantially in accordance with the Construction Documents.
