Total value of PEG capital obligations for all 8 Agencies exceeds <br />$4,400,000. <br /> <br />5. <br /> <br />Institutional (Fiber) Network. <br />a. Comcast shall provide the agencies a construction capital credit for the <br />construction of a fiber network between designated governmental/educational <br />buildings. <br />b. Final construction route and plans to be finalized within ninety (90) days of <br />the effective date of the Franchise. <br />c. Total value of the institutional network construction exceeds $3,304,000. <br /> <br />b. <br /> <br />Financial/Insurance. <br />a. Perfonnance Bond. <br />i. $250,000 each agency, if construction is commenced. <br />Security Fund. <br />i. Brisbane - $50,000; Belmont, Foster City, Millbrae, San Carlos, and <br />San Mateo County - $100,000 each; and Redwood City and San Mateo- <br />$150,000 each. <br />Liquidated damages assessed in the event of a breach of the Franchise. <br /> <br />6. <br /> <br />c. <br /> <br />Comcast has agreed to certain provisions which are included in a Side Letter Agreement <br />and not included in the Franchise. These provisions include: 1) Comcast shall provide <br />SAMCA T with an unrestricted grant of $280,000 for all 8 Agencies to offset costs <br />associated with the renewal process, 2) Comcast will provide reimbursement if it <br />relocates the PEG channels and/or PEN-TV; and 3) Comcast will display the PEG access <br />channel programming available through a menu system. <br /> <br />RECOMMENDATION <br />The negotiating subcommittee and Brian Grogan of Moss & Barnett recommend the <br />Council adopt the attached Cable Television Franchise granting a renewed franchise to <br />Comcast. <br /> <br />END OF MEMO <br /> <br />818051vl <br /> <br />.".,.,.. ..- .._....,. <br />
