("Comcast") currently provides the City of Redwood City, <br />California ("City") with cable television services. In response to Comcast's request for <br />franchise renewal the City has prepared a Cable Television Franchise Ordinance <br />("Franchise") which is based upon applicable laws and the City's future cable-related <br />needs and interests. During the Franchise renewal negotiations Comcast agreed to <br />construct a fiber network to be used by City. Below please find a brief summary of the <br />Fiber Network Agreement ("Fiber Agreement"). <br /> <br />SUMMARY OF FIBER AGREEMENT <br /> <br />Comcast will complete construction of a fiber network, on or before December 31, 2007. <br />The fiber network will connect various City, county, and public school facilities for <br />video, voice and data communications. The fiber construction shall consist of two (2) <br />dedicated fibers connected between the sites specified by the City and the City Hall. <br /> <br />Comcast shall provide the City a construction capital credit in the amount of $674,613.17 <br />for the construction of the fiber network between designated governmental/educational <br />buildings. Comcast shall not install or be responsible for any fiber network equipment. <br />The City may use the construction capital credit to purchase edge and switching <br />equipment. <br /> <br />The final construction route and plans shall be finalized within ninety (90) days of the <br />effective date of the Franchise. <br /> <br />After the fiber network has been completed, the City may request that Comcast upgrade <br />the fiber network or construct additional fiber network sites at any time throughout the <br />tenn of the Franchise. <br /> <br />833344v] <br />
