Should CITY desire to improve TRAIL within the STATE's right of way, CITY shall obtain <br />the necessary Encroachment Permit from STATE. <br />8. CITY contractors will be required to obtain an Encroachment Permit at no cost to the contractor, <br />prior to the start of any work within STATE's right of way. <br />9. CITY shall not, at any time, use TRAIL in any manner that will interfere with or impair the <br />primary highway transportation use of STATE's right of way. <br />10. CITY may install and thereafter will maintain TRAIL conforming to those plans and specification <br />(PS&E) pre -approved by STATE. The degree or extent of maintenance work to be performed, and <br />the standards therefore shall be in accordance with the then current edition of State Maintenance <br />Manual. <br />11. STATE reserves the right to use those areas within STATE right of way, including TRAIL, <br />for future construction, reconstruction, expansion, modification, or maintenance purposes <br />without restriction and/or obligations to CITY. STATE shall consult with CITY prior to such <br />work that affects TRAIL. However, STATE's decision will be final. <br />12. STATE will be responsible for repairs to those portions of TRAIL damaged as a result of <br />STATE operations on or adjacent to TRAIL, and will provide CITY with 72 -hours -notice, to <br />the CITY Engineer, prior to closing TRAIL except in cases of emergency. <br />13. The maintenance functions assigned to CITY, at CITY's expense, with regard to TRAIL are <br />as follows: <br />13.1. TRAIL PAVEMENT <br />CITY shall perform TRAIL pavement repair and replacement, crack sealing, pothole <br />patching, pavement resurfacing (overlay), emergency pavement maintenance as a <br />result of normal wear and tear and public use of the TRAIL. CITY will maintain: a <br />safe facility for pedestrian and bicycle travel along the entire length of the TRAIL, and <br />is solely responsible for all TRAIL improvements, all fences, fence gate, guard railing, <br />drainage facilities, repair of sacked concrete slope protection due to vandalism, slope <br />and structural section pavement adequacy of any bicycle and pedestrian TRAIL <br />located and constructed within STATE's right of way. <br />13.2. DRAINAGE STRUCTURES <br />City shall maintain all drainage structures related to the TRAIL or its use, including, <br />but not limited to: drainage inlets for drainage of TRAIL and contiguous areas; pipes <br />under TRAIL within State Right of Way; pipe outlet structures, flapgates, and rock <br />slope protection. CITY shall inspect TRAIL after rain events to ensure that flooding <br />of the TRAIL has not occurred. If flooding of the TRAIL occurs, and due to such <br />flooding CITY anticipates a temporary TRAIL closure lasting more than 72 hours, <br />CITY shall notify STATE with a plan of action for correcting the flooding. CITY <br />shall ensure that TRAIL users are made aware of the condition and prevented from <br />using TRAIL if a hazardous condition occurs. CITY shall inspect effectiveness of <br />TRAIL closure devices, at least semi-annually. Any defects shall result in the CITY <br />
