Time between TRAIL <br />closure for defect in TRAIL or TRAIL closure devices, and re -opening of TRAIL <br />shall not exceed 14 days except in cases of emergency. <br />13.3. LITTER AND GRAFFITI <br />CITY shall perform cleanup, debris, and sweeping operations necessary to maintain <br />the entire areas as shown on Exhibit A, in a neat and clean usable condition, free of <br />litter, debris, and graffiti. Litter, debris, and graffiti includes, but is not limited to, all <br />sand, paper, garbage, refuse, and other items resulting from public access. <br />13.4. VEGETATION CONTROL <br />CITY will perform vegetation control of all vegetative material growing within the <br />entire area as shown on Exhibit A, including treatment by chemical means and <br />brush control and tree trimming. CITY shall abide by the current STATE list of <br />approved chemicals, allowed for Vegetation Control purposes, when carrying out <br />this requirement. Such list will be available from District 04 Maintenance. <br />13.5. RETAINING WALLS <br />CITY will perform debris removal, cleaning and painting to keep retaining wall <br />structures, for the TRAIL, as shown in Exhibit A, free of debris, dirt and graffiti. <br />The structural maintenance, including inspection, maintenance, assurance of <br />effectiveness in excluding tidal flows; and any other emergency work for the <br />retaining walls shall lie with CITY at CITY's expense. <br />13.6. WALL SURFACES <br />CITY will perform debris removal, cleaning and painting to keeping the <br />bents and abutment wall surfaces free of debris, dirt and graffiti. <br />13.7. TRAFFIC SERVICE FACILITIES <br />CITY will maintain all traffic service facilities, including, but without limitation, <br />signing and striping and pavement markings required for the direction and <br />operation of TRAIL. <br />14. LEGAL RELATIONS AND RESPONSIBILITIES <br />14.1. Nothing within the provisions of this Agreement is intended to create duties or <br />obligations to or rights in third parties not parties to this Agreement or to affect the <br />legal liability of a PARTY to the Agreement by imposing any standard of care with <br />respect to the operation and maintenance of STATE highways and local facilities <br />different from the standard of care imposed by law. <br />14.2. If during the term of this Agreement, CITY should cease to MAINTAIN the TRAIL <br />to the satisfaction of STATE as provided by this Agreement, STATE may either <br />undertake to perform that maintenance on behalf of CITY at CITY's expense or direct <br />
