<br />FXS : (' ", 11/20/96 <br /> <br />(009/72) <br /> <br />shall <br /> <br />be <br /> <br />excess <br /> <br />of <br /> <br />CM/GC's <br /> <br />insurance <br /> <br />and <br /> <br />not <br /> <br />contributory with it. <br /> <br />In accordance with the provisions of Section 1861 of the <br /> <br />California <br /> <br />Labor <br /> <br />Code, <br /> <br />the <br /> <br />CM/GC <br /> <br />in <br /> <br />signing <br /> <br />this <br /> <br />Agreement <br /> <br />certifies to City as true the following statement: <br /> <br />"I am aware of the provisions of Section 3700 of the <br /> <br />Labor Code which requires every employer to be insured <br /> <br />against <br /> <br />liability <br /> <br />for <br /> <br />workers I <br /> <br />compensation <br /> <br />or <br /> <br />to <br /> <br />undertake <br /> <br />self-insurance <br /> <br />in <br /> <br />accordance <br /> <br />with <br /> <br />the <br /> <br />provisions of that Code, and I will comply with such <br /> <br />provisions before commencing the performance of the <br /> <br />work of this Contract. II <br /> <br />CM/GC shall be responsible for, <br /> <br />and shall obtain and file <br /> <br />evidence of coverage on behalf of all his/her Subcontractors. <br /> <br />All such evidence shall be filed with the City Clerk. <br /> <br />Should any <br /> <br />such policy be <br /> <br />cancelled before <br /> <br />final <br /> <br />completion of the work <br /> <br />herein contemplated, and should CM/GC fail to immediately procure <br /> <br />other insurance as herein required, <br /> <br />then City may procure such <br /> <br />insurance and deduct the cost thereof from the amount due the <br /> <br />CM/GC. <br /> <br />21. <br /> <br />COMPLIANCE WITH LABOR LAWS. <br /> <br />(a) CM/GC shall comply and <br /> <br />shall cause compliance with all applicable provisions of Section <br /> <br />1810 to 1815, inclusive, of the California Labor Code relating to <br /> <br />working hours. <br /> <br />CM/GC shall, as a penalty to City, forfeit Twenty <br /> <br />Five and No/I00 Dollars ($25.00) <br /> <br />for each worker employed in the <br /> <br />execution of this Agreement by CM/GC or by any Subcontractor for <br /> <br />each <br /> <br />calendar <br /> <br />day <br /> <br />during <br /> <br />which <br /> <br />such <br /> <br />worker <br /> <br />is <br /> <br />required <br /> <br />or <br /> <br />l7 <br />
