<br />ð,A . z <br /> <br />Section 6.04.010 (Exhibit A, page 2) contains definitions of the terms used in the animal <br />control ordinance. Of particular interest are the definitions of dangerous and vicious <br />animals. The treatment of dangerous and vicious animals has been significantly revised by <br />the amendments set out in Exhibit "B". Attention is invited to subsection (h) and U) of <br />Section 6.04.010 as it appears in Exhibit B, pages 2-4. <br /> <br />Section 6.04.020 (Exhibit A) sets out the responsibility of enforcement, along with a <br />recitation of the scope of authority of animal control officers, as well as humane officers <br />defined in Section 2 of Exhibit "B", page 4. <br /> <br />Section 6.04.030 of Exhibit A, page 3, contains requirements for vaccinations of dogs and <br />cats after such animal attains the age of four months and/or within ten (10) working days of <br />purchasing a license for the animal. <br /> <br />Section 6.04.040 of Exhibit A, page 3, sets out requirements for dog and cat licenses, as <br />well as wolf hybrids. <br /> <br />Section 6.04.045 of Exhibit A, page 4, provides that instead of the annual license provided <br />in Section 6.04.040, a three-year license may be obtained for cats or dogs (excluding wolf <br />hybrids) by submitting proof of a three-year's rabies vaccination and paying applicable <br />fees. Fees for the animal control program appear in Section 6.04.290 of the County Code, <br />Exhibit A, pages 11-14. <br /> <br />Section 6.04.060 of Exhibit A, page 5, requires that dog owners (defined in amendments to <br />Section 6.04.010 shown in Exhibit "B" at page 2 as a person over 18 years of age who <br />holds the license to the animal, or the person who has primary responsibility to care for the <br />animal) must prevent it from biting or physically harassing any person engaged in a lawful <br />act and from interfering with the lawful use of public or private property. An owner (or <br />possessor) of a dog must prevent it from causing substantial injury to another domestic <br />animal lawfully upon public or private property. Substantial injury means any injury which <br />results in treatment by a veterinarian or death. Owners and possessors must desist from <br />commanding a dog to attack or threaten a person who is peacefully and lawfully upon <br />public or private property. Violation of these provisions constitutes a misdemeanor. <br />Trained dogs assisting a peace officer engaged in law enforcement duties are excluded <br />from the above provisions. <br /> <br />Section 6.04.070 of Exhibit A, page 5, contains specified prohibitions for animals including <br />licensing, leashing (except for cats), control of barking or meowing. <br /> <br />Section 6.04.100, 6.04.105 added by Exhibit B, pages 7-9 and Sections 6.04.115 and <br />6.01.120, Exhibit B, pages 9-17, pertain to dangerous animals. These revisions <br />significantly revise requirements for dangerous animal permits, adopting a new hearing <br />procedure to be followed in declaring an animal vicious (Section 6.04.115). In addition, <br />significant conditions may be imposed on dangerous animal permits.
